Right, so i'm sitting on my work bench in the garage, sipping a beer with the garage door open and dog sitting on the floor next to me, just observing the neighborhood, and 3 teens walk by. I recognize one of them as the 2 doors down neighbor and nod at him, they all nod back and keep on walking.
Situations like this always make me start playing out scenarios though. So what if these three were walking around looking for an easy opportunity to rush someone, saw me sitting alone in the garage with a beer and thought, "easy mark." When the EMT's and cops showed up 2-7 minutes later would i be in trouble for discharging a firearm while intoxicated? I'm in my garage on my property (fine my landlords garage and his property, but still) defending myself. Is there any "gray area" when alcohol comes into play in a situation like this? IBOCTPBTKBO (in before op call the police before the kid bleeds out)

I hear ya bro. I feel the same way when the Girl/Cub Scouts knock on my door selling cookies and I'm home alone...clearly I'm no match for them.

I really wonder if Castle Doctrine would help protect against prosecution in a case like that (assuming OP's state has it).
I've wondered about this, too.

Girl scouts don't wear flat billed wide rim baseball caps, sag their pants down to their knees and pull the kind of dumb shit i've seen these kids do. If you don't think 16-19 year olds are capable of some atrocious actions, then i envy where ever you live that you can maintain that outlook. |

You mean there are people sitting in garages in Texas that haven't been drinking beer?
Quoted: You mean there are people sitting in garages in Texas that haven't been drinking beer? touche sir. I know people that spent more money on the construction phase of their garages than they did on any other part of the home, including kitchen. If memory serves, he had a separate breaker box and power line hung just for the garage since he just HAD to have 4 220v sockets, and that's just the beginning.

Don't give the cops a reason to give you a breathalyzer

Afterwards call the cops and start doing shots. Its very stressful and you tried to calm down after that fact.
But in reality a good shoot is a good shoot no matter your condition. |
In my garage? Hammers, chainsaw, axes, torches, hockey sticks, baseball bats, tire irons, lawn mower blades, outboard motor props, golf clubs, machete, various saws, a couple of bows, and allegedly there's mini flamethrower in there somewhere - all within arms reach, that's not even getting to the concealed pistol on my hip - It would be a very bad Darwin moment either for them, or for me as the selection might make me hesitate in picking just the right weapon for "shock and awe".
Eh. Couldn't tell you. Best to ask a lawyer. But I can tell you what I'd do. I'd shoot if they rushed me.
Quoted: Don't give the cops a reason to give you a breathalyzer /hide the emptys Here is a news flash. People that have been drinking REEK of booze. OP, I'd imagine that would depend on just how much you've had to drink. One or two beers? I'm sure you would be fine. |

Glad my neighbors don't sit in their garages drinking beer observing the neighborhood. They would be dealing with Code Enforcement before any perps even had a chance to rush them.
