If you have a semiauto pistol but fire it with the end of the reciever tucked against your shoulder, will the ATF nail you for making a SBR?  There are no modifications to the pistol as it was manufactured, no stock added, just pulling it against your shoulder...  OK, it sounds like a stupid question but there are stupid laws so I just wondered...

Well, it shouldn't be illegal as the end of the receiver was not "Designed" as a stock to be "fired from the shoulder", regardless of how you use it.  Technically, the definition of pistol includes designed to be fired in one hand, but they don't arrest everyone who uses a 2-hand hold.

That said, I will quote the timeless words of the Wise Old Preacher to Bart in Blazing Saddles: "Son, you're on your own!"

The ATF should nail you just for owning something that ugly.    But if Bushmaster is legally allowed to sell it as a pistol, then you can put the backside of it anywhere you want.
