Jun 23, 10:58 AM EDT Woman Enters Plea in'Windshield' Death By ANGELA K. BROWN Associated Press Writer FORT WORTH, Texas (AP) -- A former nurse's aide pleaded guilty to a lesser charge Monday before she went on trial on a murder charge, accused of hitting a man with her car and leaving him stuck in the windshield as she drove home. Chante Jawan Mallard, 27, faces life in prison if convicted of first-degree murder. She pleaded guilty to a charge of evidence tampering before attorneys began their opening statements on the murder charge. The grisly death shocked the nation when details of the accident came to light in February 2002. On Oct. 27, 2001, the body of Gregory Biggs, a 37-year-old former bricklayer who had been living in a homeless shelter, was found dumped in a park. Police had no leads in the case until four months later, when a tipster said Mallard talked about the incident at a party. Police said Mallard confessed to police that her car had hit Biggs with such force that his head and shoulders jammed into the windshield and his legs were bent over the roof, his pants tearing almost completely off his body. Instead of stopping, police said, Mallard drove about a mile down a divided six-lane highway, the man still lodged and bleeding in the jagged windshield, then continued through town to her small house in a working-class neighborhood. She pulled into her garage, lowered the door, then sat in the car and cried, repeatedly apologizing to the man who was moaning, she later told detectives. "Chante kept going in and out of the garage telling the man she was sorry," the police report states. "She does not know how long it took the man to die; she quit going out into the garage." Mike Heiskell, Mallard's attorney, said last year that his client "was simply a frightened, emotionally distraught young woman who had an accident, panicked and made a wrong choice." He said she is guilty only of failing to stop and render aid - not murder. Police found the car in the garage, the seats missing and the windshield and rear glass broken. Officers said they found dark stains on the passenger-side floorboard and burned car seats in her back yard. Two of Mallard's friends, Clete Deneal Jackson and Herbert Tyrone Cleveland, have pleaded guilty to dumping the body to help Mallard. Jackson received a 10-year sentence for tampering with evidence; Cleveland, nine years. As part of plea agreements, they were to testify at her trial. Police initially said Biggs had lived for several days in Mallard's garage, slowly bleeding to death from his multiple fractures and cuts. But Tarrant County Medical Examiner Nizam Peerwani later said Biggs, whose left leg was nearly amputated, probably lived only a few hours after he was hit. He could have survived if he had received medical attention, Peerwani has said. Police, prosecutors, defense attorneys and others involved in the case have not commented about it publicly since state District Judge James R. Wilson imposed a gag order after Mallard was indicted last year.

But is she still going to be tried for murder? I hope so.

And this isn't being considered a hate crime why? You know if it were the other way round, Jessie, Al, & Louis would be beating the war drums and screaming bloody murder everynight on the news until the driver was UNDER the jail. Got to love the double standard.

So they're dropping the murder charge?
Link Posted: 6/23/2003 7:36:19 AM EDT
IIRC, her alleged statements at this party were essentially brags around how she hit and killed a white man.

i hope the stupid bitch likes jail food. im sure a lifetime in jail, and she'll get used to it. fucking murderer.

The DA is probably afraid a "jury of her peers" [rolleyes] wouldn't convict her on a murder charge.......

Murder requires that you prove intent. What makes you think the DA can prove that this knucklehead INTENDED TO KILL this guy? She probably plead to reckless homiccide or manslaughter, a crime that does not require proof of intent, only stupidity.

only a few hours. i love how they say it that way. makes you think he didn't suffer very long because it was ONLY a few hours instead of a couple days. i say run the dumb bitches head through a windshield and see how she likes to be left dangling there will her murderer comes out and taunts her occasionally. i don't see the problem, just so long as you ONLY leave her there for a couple of hours.

I never heard that. Surely, it's not true?? Anyone else?? Links that don't go to the National Alliance web site???

If he was dead on impact, I might have some sympathy for her... but this is like a horror movie. He was still stuck in her windsheild moaning, probably asking her to help him, and she just leaves him there to die in her garage. I don't care if she was in shock or what, I'd give her no mercy because she left him there and he slowly died. Dump her on the island. Anyone ever see the movie "No Escape."? Best idea anyone ever had.

I very clearly remember the same thing. Seems after she stashed her car she went to a drug/sex party and told some people there what had happened. She also was reported to have gone back to the garage and apoligized to the victim (while he was still wedged in the windshield). If anyone has access to professional news service searches, I'm sure they'll be in there. I doubt the mainstream sites will have kept this stuff. Ah, current report: http://www.cnn.com/2003/LAW/06/22/windshield.death.ap/index.html Woman stands trial for killing homeless man Monday, June 23, 2003 Posted: 3:06 AM EDT (0706 GMT) FORT WORTH, Texas (AP) -- It was hours before dawn on a highway southeast of downtown. A homeless man walked along a shoulder of the road as a former nurse's aide drove home after a night of drinking at a bar. What happened next isn't clear. All Chante Jawan Mallard could remember, according to police reports, was that her Chevrolet Cavalier hit the man with such force that his head and shoulders jammed into the windshield, shattering it, and his legs bent over the roof, his pants tearing almost completely off his body. Instead of stopping, police say, Mallard drove about a mile down the divided six-lane highway, the man still lodged and bleeding in the jagged windshield, then continued through town to her small yellow house in a working-class neighborhood. She pulled into her garage, lowered the door, then sat in the car and cried, repeatedly apologizing to the man who was moaning, she later told detectives. "Chante kept going in and out of the garage telling the man she was sorry," the police report states. "She does not know how long it took the man to die; she quit going out into the garage." It wasn't until the next day that Gregory Biggs, 37, a former bricklayer who had been living in a Fort Worth homeless shelter, was found dead, his body dumped in a park a few miles from Mallard's house. Now, nearly two years later, Mallard, 27, heads to trial Monday on charges of murder and tampering with evidence. She faces life in prison if convicted. Two of her friends, Clete Deneal Jackson and Herbert Tyrone Cleveland, have pleaded guilty to dumping the body to help Mallard. Jackson received a 10-year sentence for tampering with evidence; Cleveland, nine years. As part of plea agreements, they will testify at her trial. Police initially said Biggs lived for several days in Mallard's garage, slowly bleeding to death from his multiple fractures and cuts. But Tarrant County Medical Examiner Nizam Peerwani later said Biggs, whose left leg was nearly amputated, probably lived only a few hours after he was hit the morning of October 26, 2001. He could have survived if he had received medical attention, Peerwani has said. Police, prosecutors, defense attorneys and others involved in the case have not commented about it publicly since state District Judge James R. Wilson imposed a gag order after Mallard was indicted last year. When Biggs' body was found in the park, authorities had no leads until four months later, when a tipster said Mallard talked about the incident at a party. The woman said they were discussing who would be the designated driver, because some in the group had been drinking, and that Mallard said she couldn't use her car, police said. The woman recalled that Mallard giggled when she said "I hit this white man," according to the police report. The woman said Mallard told her she "was messed up" on ecstasy pills and drunk. Mallard and her boyfriend later went into the garage to see if the man was dead, but he was alive and even asked for help, the woman told police. The day after interviewing the tipster in February 2002, detectives went to Mallard's house with a search warrant, and they said she confessed. Police found the car in the garage, the seats missing and the windshield and rear glass broken. Officers said they found dark stains on the passenger-side floorboard and burned car seats in her back yard. Mallard's attorney Reagan Wynn said at June 10 court hearing that some media coverage of the case -- including a report that Mallard had sex with her boyfriend after arriving home and that she left Biggs in the garage for days -- were inaccurate. Wynn requested that the trial be moved out of Fort Worth. The request was denied.

I am digging for it, but I am positive I remembered reading that about this case. I found one newspaper link to the story that said how she giggled at the party and talked about even having sex with her boyfriend while the dude was in the garage dying. http://www.dfw.com/mld/startelegram/2817260.htm I will keep looking for it, but I am sure this was also reported somewhere on the web ("reputable" news media site).

He pointed out allegations that Mallard had had sex with her boyfriend after the wreck and that she left Biggs in the garage for days, ignoring his pleas for help.

I agree she injured the man and prevented him from getting medical attention. I wonder if they could charge her with felony murdr? Is hit and run a felony? Mike Heiskell, Mallard's attorney, said last year that his client "was simply a frightened, emotionally distraught young woman who had an accident, panicked and made a wrong choice." He said she is guilty only of failing to stop and render aid - not murder. Made a wrong choice? WTF She not only failed to stop and render aid she hide his body while he died. I realize her attorney needs to defend her but how can he say shit like that with a straight face.

Jeffery Dahmer made the wrong choice when he made Phillipino Stew too.

Depraved Indifference sounds right. Hit a guy driving while under the influence. Continue driving down a highway, then through a town with some guy sticking thru your windshield. Park/ hide your car in a garage and refuse to render aid or summon help after the request from the injured party. Left injured party to die, then attempt to hide evidence of incident. She's gonna burn.

I completely agree. If it had thrown the guy and she just drove away, then yeah. But to hide the dying victim - she made sure NOBODY could render aid. She injured him in the "accident" and murdered him by preventing ANYONE from helping him. Oh, and YEAH - DOUBLE F'n STANDARD!!! CR

Thanks Bendover, for taking the trouble to find the link. I'd be willing to bet, that this "White Man", was listening not to the perp apologizing, but rather, his last human contact was being taunted, and tormented, because he was white, while he suffered, and finally died, with the voices of his killers echoing in his ears..[:|]

I don't care what race she is. What she did was subhuman and she deserves to pay the price.

JimBeam, you beat me to it. As I read the transcript posted above the word that came to mind was "subhuman." It's sickening that someone who would act like this has the same rights as a person who is conscientious, law-abiding, kind, and considerate. But then that's what makes this a great country, eh? <<>>
