Unless there's a specific reason to blast him with the taser. Was this the last few seconds of a 10 minute battle to get him to come quietly? If so, sure I can see using the taser being reasonable. But instantly tasing him the nano-second he puts his hands behind his head because you specified behind his back seems unreasonable, absent other info. Maybe I just wasn't "trained to win" like some. He was being order to the ground, he instead stood up. What can somebody do when they're standing up that they can't do very well while kneeling or lying prone? Charge at you. If you are giving orders to drop to the ground or your knees, and the subject stands up, chances are things are heading south. That is why the taser was deployed. When it comes to situations like this where it is obvious this guy wasn't listening to anything the LEO's were saying, you don't just sit around and wait for him to charge you. If he was just simply to drunk to understand, maybe it would be wise advice to not get so shitfaced that you interact with officers and can't even comprehend plain english.

A lot of fail on both sides, as obnoxious as the guy was, he could've been in handcuffs, in the car, much faster. I wouldn't have pulled my taser in that situation, just not enough justification. With two officers, and a guy just being drunk, they should've been able to control the situation and subdue the suspect.
The head kick I feel was reactionary because the guy may have made a move to bite the officers hand, but still a bad move. I have a feeling Rehobeth cops are going to become bad case law over this one. |

I was LE in a pretty liberal, shore town, granted it's pretty hard to get more liberal than Rehoboth Beach, and my experience was different. The cops were all pretty much still a conservative bunch.
