Is legal to simply shave off the bayonet lug on a pre ban upper so that it can be used on a post ban lower?

Yes, provided you also shave off the barrel threads, or permanently affix a post-ban legal muzzle brake or compensator, as well.

Yes, although it won't be OK on a post-ban if it has threads capable of accepting a flash hider.
