Inroduced by Senator Feinstein, Boxer, Lautenberg and Schumer in the Senate, and introduced by Congressman Meehan from Massachusetts in the House, the "Sales Act" would require all handgun buyers, new and used, to have a firearms license. To get the license the applicant would have to:
- Give all personal data
- Submit thumb prints
- Current photo
- Sign, under penalty of perjury, that all information is correct
- Pass a written firearms safety test
- Agree to three years in jail if any firearm they own is involved in an accident with a child
- Pay a fee for the above
- Those who fail to license themselves as a firearms holder, but own firearms would have a $500. fine forthe first offense, and $5000 fine for subsequent offenses
- Failing to report a change in address would be a $5000 fine
- Failing to report a stolen firearm would be a $5000 fine
- Dealers who are not maintaining adequate records in the opinion of the government would get two years in prison
- Firearms owners who allow children reckless access to guns would get three years in prison
- All sales, new and used could only be made between license holders with an approved NICS check
