Under what authority does a high school suspend students for committing an act not on school grounds, for refusing to sign away their 1st amendment rights to free speech?

The problem is that this act didn't occur on school grounds and thus they have no authority over it and cannot impose a "gag order" over it.

No, it's correct. The kids weren't on a field trip or any other event that would otherwise have them in the school's custody. What they do in their own time is their own business and if it's an illegal tresspass, it's under the police's jurisdiction (and ultimately their parents).

This "feel good" socialist state mentality is just something the principal did to get in the news. You'll note that he didn't try to suspend them for the hazing incident itself (because again, the school has no jurisdiction) so he created an artificial reason (and a laughable one at that - don't talk about the hazing incident or I'll suspend you?)

... Not without double duty prophylactics son, or you'll be grounded to your room for a month!

Everybody gotta die sometime...
