I'm trying to find out some information about how to get an investigation initiated because my supervisors at work are utter dumb asses. I work for TSA and on Friday while searching a bag, I came across about 2 pounds of grass and a couple hundred pills of MDMA (ecstasy).

The airport police didnt want to take custody of it and accused us of an unlawful search violating the 4th Amendment (apparently he was sick the day they taught law in the academy) because we are covered under the Administrative search provision of the 4th Amendment of the US Constitution.

So now I'm trying to find out if ecstasy is a big deal for DEA and how to go about contacting them. I know this falls under DEA jurisdiction because it was a domestic flight staying inside the US.

You can also try the state LE or county office. Both would (most likley) have jurisdiction over the area.

That wouldn't be a bad trafficking case, but getting the feds to jump on it is harder than the state court.

So, where are the drugs?

You should have a ladder plan, contact one agency after the next i.e., local, county state/task force, fed......

So the rocket scientist officer(s) that showed up think that all the TSA operations should shut down operations immediately in the U. S. since all of their searches are a violation of the 4th Amendment. I think he/they missed more than a day of the academy and quite a few of the in-service or legislative updates.. whatever they call it in VA.

I would call your local Acency hopefully they have an interdiction team that would handle it.. I will tell you that the feds really will not take ecstasy unless it is + 800 pills (at least where I am in VA) Weed you are going to need more.

That is a big deal for DEA in my area and more than enough for trafficing.  Call the local field office or the nearest big LE agency.  

I work narcotics now and have a lot of contacts in DEA in my area.  Any narc should be able to get you in contact with the local DEA office.

Nice bust.  Good job.

And if you can't make a criminal case....well you still aren't going to give him his drugs back!!!

My supervisors in their infinite wisdom decided to let the Airport police get involved, instead of jacking it up to the federal level after they accused us of performing an illegal search.

I suggested calling the feds but got shot down by our screening manager. AFAIK, DEA would be the ones to deal with this because it was outbound on a domestic flight that originated here in the US.

That is a big deal for DEA in my area and more than enough for trafficing.  Call the local field office or the nearest big LE agency.

Nice bust.  Good job. Thanks, I found it after our Explosives detection System alarmed on the bag because of a dense object. SOP says we have to search everything within a certain radius of the object that alarmed, the ecstasy was inside an empty cd wallet and fell out when I was opening it to examine it's contents, the grass was out in the middle of the bag.

And if you can't make a criminal case....well you still aren't going to give him his drugs back!!!



FWIW, they just changed our job titles and series for all TSA Screeners, we are now Officers and the airport police weren't happy at all to find that out.

One of the best lines I heard that day was from a coworker:

Airport PD officer:  "how do you know those pills aren't somebodys normal medications?"

Coworker: "I didn't get the memo about having pictures of hearts imprinted on pills, so you're saying this is for someone who cant read, in order to know that its their heart medication?"


The look on his face when she said this was classic, he walked right into it.

DEA handles major drug crime...

Posession & transport across state lines -> call the fibbies...

(Would make a nice on-landing reception... Um, excuse me sir, I'm with the FBI, we have a few questions for you about your luggage)....

I'm suprised you guys don't have official procedures for finding drugs... I mean, if you find a bomb, or catch someone trying to sneak a gun on a plane, who do you call? Why would the feds overlook a genuine law enforcement oppertunity?

LMAO, you have no freaking idea how close to the truth you are......

Metro Wash Airport Authority Police actually did arrest him after he got on his plane.  I know this is going to surprise you all to find out that he was heading to Oakland, CA.


ICE makes a TON of seizures each year (I think Drugs cases are in their top 3 tasks). Most cases involving a port of entry go through them (port of entry being inland, border, waterway, etc). The FBI isnt the only agency with jurisdiction across state lines.


I know all about ICE dealing with P.O.E.'s, my father retired from ICE / US Customs after 30+ yrs and I've learned alot from him.  And he's been teaching me all about federal narcotics, customs, & immigration laws.

As a matter of fact I just got my selection leter this past Tuesday to become a Special Agent with ICE. I have my medical evaluation within the next week or so. I should be going through FLETC's Basic Special Agent course within the next couple of months.  How's that to top off the "find"? Needless to say it has been one hell of a great week for me!!!!

Next time consider the State Police. Their investigative division is quite tenacious, and I think you'd be pleased in dealing with them. Plus, they have dealt with taking over investigations from departments which are questionably competent and making good cases out of them.

Also, they probably are easier to convince to get on board than the Feds.

NOVA has an entire VSP Division themselves... give them a call.

 If BP is in the area, grab one and let him know next time if possible.  They have some title 21 enforcement authority.  At the least, they can hold the guy and start the investigation until the DEA decides if they want it.  Good catch BTW.

The problem with Title 49, which the TSA searches under, is that you are allowed to search for prohibited items as per "the list".  Narcotics, currency, porn, etc. are not under covered under the statute.  The airport authority/local PD is responsible for these violations.  Customs would get involved if you could show a Nexus to international travel.  DEA likes the bigger stuff.  

There have been a number of problems with screeners notifying LEOs every time they find large amounts of currency in hand carried luggage.  This could be a reason for the LEOs not wanting to do anything.  I agree with getting the State Police involved if the local LEOs refuse to intervene.

I'm former Customs and now work in a division of TSA.  Good luck with CI school and what was once known as CBES.  I hear ICE isn't as fun as it used to be.

TSA seems to be fixated on stopping someone from hijacking the plane they are riding on that day, and igoring any evidence they come across that might indicate the subject intended to commit a terrorist act later.   As incredible as it seems, I have been told by numerous people that work there if they come across a middle easter male on the terrorist watch list, who had a million dollars cash on him, that they would merely search him well for a weapon, and finding none, would let him on the plane and not call anyone.   Same thing for drugs, despite tons of evidence of the terrorist using drugs to finance their operations.

There was a right way and a wrong, feel good, touch feely,  way to make our airports and planes safe.  The Israelies have the perfect model for the right way that we could have copied, but we went with the feel good method.
