I was in Mini-Mart last night getting a drink. I asked the lady at the counter how her night was going to which she replied "Not good at all". She explained that some 19-20 year old idiots were in the store a bit ago and stole a whole bunch of stuff. She stepped outside to get the license plate number and the kids told her that they would be back for her. She hit the silent alarm but the police didnt respond as fast as they were supposed to (big supprise!). The lady was a bit freaked that they threatened to come back. I asked if she had a way to defend herself and she didnt. So I offered up my can of OC spray which she was extremely grateful for (I'm guessing I get free refills from now on :) ).

I'm just not sure if I could be held responsible if she used it.

Inside I know I did the right thing but with all the sueing that goes on sometimes you question yourself.

I would think as long as pepper soray is legal in your state & locallity it woould be alright.

How in the hell are they going to know who you are? They are going to track down your viedo capture or your CC because some lady OC sprays some punk ass?

Your over analyzing this. Next time give her the address and number of your local gun store and firing range

You did the right thing in my humble opinion. I did the same for a tenant in our building when her fool of an ex was causing grief and threatening her.

Being that you are a proponent of "Self Sufficient Living",why were you in a Mini-Mart ?

You did right though IMO,whether you can get sued or not,I have no idea.You have to have a license to own that stuff here in MA.

It's not a question of whether they would sue you, it's a question of whether a lawyer would represent them in suing you.

...and for that to happen, you would have to have something that the lawyer wants...money. So, if you're an average joe - no, you're not going to be sued. The lawyer would go after the mini-mart.

Don't second guess yourself you did the right thing by going on gut instict. What would have been wrong would be to offer to assist. That could have lead to problems for you. Good job. Now go back, and get her into a training/safety class and get her on the range. If your single you really missed another opportunity

Sounds to me like you did the right thing, and I'm sure she was very appreciative of your kindness.

OTOH, wouldn't it be a hoot for a few CCW members to be waiting for these punks if/when they returned...assuming the LEO's didn't show again.

I think that you did the right thing.

My wife, who is about to graduate law school, says that you couldn't be "successfully" sued for it. I must agree.....since she is my wife

you probably will never hear another thing about it. If it was me I would go back in a day or two, ask he how things worked out. If she is hot, or even do-able, obtain phone number.

Probably a better thing to do for her is offer to take her to the range. Teach her how to shoot. Then she can buy a .38 wheelgun and not have to worry about 'some 19-20 year old idiots'. A formal course and a review of WY's use-of-force laws wouldn't hurt either. That whole 'If you build a man a fire...' stuff.

I think that is the best line I have heard in a long time. Congrats Rusty Gun. That is the truth, today everybody is worried about getting sued over anything today. Be a man don't live in fear. Do what you think is right and worry about the rest later.

I see a lot of post about people having to draw down on some one by folks this board. I am sure most of them are a fantasy. Well, as a civilian I have been in a real so called "Draw Down on Someone" situation and at no time during the event did I think about being sued or the law. I was woried about one thing ,my survival. Thank God no shots were fired but I am sure my rifle saved my life that day.

I feel bad for even questioning whether it was right or not. When I did it I didnt even think twice. It was after I was in the car that I started thinking about all the stupid lawsuits that people bring.

When I worked in one, it was and this is quoted directly from my boss. "shoot the fuckers, or my boss will shoot me and you" but this pertained to robbery more than shop lifting. I had pepperspray for the shoplifters. I was told to use it to.
