If this ban gets enacted:

www.legis.state.pa.us/WU01/LI/BI/BT/2003/0/HB2451P3471.HTM

a) Offense defined.--No person shall possess or have under
2 the person's control both of the following at the same time,
3 except as provided under subsection (b):
4 (1) a semiautomatic or pump-action rifle or
5 semiautomatic pistol capable of accepting a detachable
6 magazine; and
7 (2) any magazine capable of use with that firearm that
8 contains more than ten rounds of ammunition.
9 (b) Exceptions.--Subsection (a) shall not apply to any
10 person while lawfully doing either of the following:
11 (1) engaging in shooting at a duly licensed, lawfully
12 operated shooting range; or
13 (2) participating in a sporting event officially
14 sanctioned by a club or organization established in whole or
15 in part for the purpose of sponsoring sport shooting events.

I see no law enforcement exemption for this. So cops would have to carry 10 round magazines in their handguns.

26 (2) Any pistol that is capable of accepting a detachable
27 magazine at any location outside of the pistol grip.

It's talking about 'assault weapon' type pistols. Not your standard Beretta, Colt, etc.

I am going to be really pissed off if this becomes a reality - I moved here for the ability to shoot what i want..and the fkn demoncrats have followed me from NJ.

I am moving to fkn Alaska

Even so, 'outside the pistol grip' still leaves MACs and Uzis. It's a good thing they don't have actual gunnies writing these laws, they'd be airtight and hose us good.

WRONG!

4 (1) a semiautomatic or pump-action rifle or
5 semiautomatic pistol capable of accepting a detachable
6 magazine
; and

For the purposes of that subsection it means ANY pistol w/ detachable mag.

You are still allowed to posses your magazines over 10 rounds, just only for shooting at a shooting range or NRA high power.

My point was it doesn't even exempt the police from the section I posted.

Of course this bill won't pass.

The reality of the situation is that law enforcement would be de facto excluded from any such law, regardless of wording. I'm sure the ATF would be just lining up to bust cops for having full cap mags, right?

No they could be busted.

Otherwise you wouldn't see all the LEA/LEO exemptions in various gun laws.

They are exempted in the section above.

Okay, here is the text. Maybe I'm really missing something, or totally misreading it:
Using my Taurus PT-92 as an example

5 (1) Any semiautomatic pistol or semiautomatic or pump-
6 action rifle that is capable of accepting a detachable
7 magazine and that also possesses any of the following:

Okay, my Taurus is a semi-auto that accepts a detachable magazine

8 (i) If the firearm is a rifle, a pistol grip located
9 at the rear of the trigger.
10 (ii) If the firearm is a rifle, a stock in any
11 configuration, including, but not limited to, a thumbhole
12 stock, a folding stock or a telescoping stock, that
13 allows the bearer of the firearm to grasp the firearm
14 with the trigger hand such that the web of the trigger
15 hand, between the thumb and forefinger, can be placed
16 below the top of the external portion of the trigger
17 during firing.
18 (iii) If the firearm is a pistol, a shoulder stock
19 of any type or configuration, including, but not limited
20 to, a folding stock or a telescoping stock.
21 (iv) A barrel shroud.
22 (v) A muzzle break or muzzle compensator.
23 (vi) Any feature capable of functioning as a
24 protruding grip that can be held by the hand that is not
25 the trigger hand.
26 (2) Any pistol that is capable of accepting a detachable
27 magazine at any location outside of the pistol grip.

But again, none of the above are relevant to this pistol either.....

28 (3) Any semiautomatic pistol or any semiautomatic,
29 center-fire rifle with a fixed magazine that has the capacity
30 to accept more than ten rounds of ammunition.

The only semi-auto pistol that I can think of that has a fixed magazine, right off the top of my head,
was that POS Grendel .380.

If I'm missing something, please show me where, and I'll admit that I'm wrong. But right now, I just
don't see it......
