NYSP received a notice that "David Lewis" with an age was mentally ill. They found two men with that name who had pistol permits and wrote to both counties to have their permits revoked The guy got a letter telling him "show up and turn in your guns" had to show he was not crazy (neither gunowner was crazy) and then got his permit back

Supreme Court refused to hear a case about our corrupt pistol permit system on Monday and the local and appellate Fed courts in the area always say it's fine Of course our state court judges always rule that they have the right to do what they want

So it's not like the case in NJ where the police are at your house asking to see your stuff without a warrant; a judge has already revoked your permit (without due process) and you are technically in violation of NYS firearms law, but you are extended a "grace period" to give up without a fight. I wonder how long before some enforcers start eating lead over this shit. |

It's notoriously difficult to get guns back from the police, and some departments have a policy of destroying guns that have been in their possession for more than a year, without any due process or court order. I've had to get orders from judges directing my county sheriff not to destroy my clients' guns. At least the judges are pretty good about that.

My suspicion is the Court feels like if screwed up taking the gay marriage cases v. letting the drama play out more in the states and seeing how it shakes out as far as whether most states end up enacting gay marriage. The Court made a similar mistake in Roe v. Wade of leaping into the abortion fight before it had really played out completely in the states and basically stifling the debate by taking over and making up their own rules. I fear that after Sandy Hook the court decided to see how gun grabbing plays out over the next few years |

Basically no semi auto magazine firearms are legal now except a few hunting rifles, the Ruger mini carbines, semi auto .22s and maybe a couple of other things I am not thinking of.

What about long guns? In addition to needing a permit just to touch a handgun, each county can place restrictions on when you can use it. For instance. Cortland County will always issue unrestricted, meaning that anywhere in the state, except NYC I can carry concealed. My friend in Tompkins county can only get a restricted permit, meaning he can't leave the house with it unless he is going hunting or to the range. But I can go over and visit him and carry all over the county no problems. It is so stupid. |
