. . . in a custody battle between the one who supplied the egg (fertilized by a sperm donor) and the one who had it implanted and gave birth to the kid.

http://news.yahoo.com/biological-mom-kept-child-lesbian-legal-case-223154903––abc-news.html

Tina's biological daughter turned 8 this week, but she has not seen the girl since Dec. 22, 2008, because of a custody fight with her former lesbian partner. The partner is unrelated to the child, but gave birth to her.

"I thought I'd have her back on her birthday," said Tina, a law enforcement officer, whose name was never on the birth certificate and who has been denied parenting rights under Florida state law.

Tina's egg was fertilized with donor sperm and implanted in her partner's womb.

But when their romance fell apart when the child was 2, the Florida courts had to decide, who is the legal parent, the biological mother or the birth mother who carried the unrelated child for nine months in her womb?

A trial court summarily sided with Tina's ex-partner, citing Florida statute. "The judge said, 'It breaks my heart, but this is the law,'" according to the birth mother's lawyer, Robert J. Wheelock of Orlando.

But on Dec. 23, a state appeals court rejected the law as antiquated and recognized both women as legal parents.

Maybe a dupe, but haven't run into a thread yet, so what the heck.

ETA: changed title to garner more interest.

It's actually interesting from a legal perspective. Who has more rights –– who has ANY rights –– the woman whose ___ a baby got pushed out of, or the woman who is genetically related to the baby? Was one merely an "egg donor"? Was one merely a "host"?

when gay men are docking, one has to be the host and the other the donor. who is the top and who is the power bottom in this situation?

it really isn't clear.

I do know a lesbian couple who have a child together. Not married, but living together. The mom (artificial insemination, but she actually gave birth) decided to move out and leave the state. The live-in girlfriend went to court and the judge kept the mom from leaving with her child. She had to stay and give the girlfriend visitation.

Very interesting.

Your question is easily answered: only one woman is actually the parent of the child. The other was simply a surrogate, and has no biological link. Just because I play host to a bacterium does not mean that it is part of my family lineage, nor does it carry half my genome. The surrogate mother has less rights to the child than the anonymous sperm donor.

The surrogate mother should have never been granted custody, or parental rights. If the child was effectively removed from the care of both biological parents, then in that case I might say it's reasonable to allow the surrogate as much opportunity as the extended biological family to adopt the child.

Sorry, but that's basic biology. If your personal philosophy or legal code disagrees, then frankly they're fucking wrong and you need to get with the program. There's no ifs, ands, or buts about it.

That would have been my guess, but Florida's laws were such that not only did the genetically-unrelated woman have parental rights, the genetically-related woman not only had no rights but also wasn't allowed on the birth certificate AND the lower court ruled against her.

Yea it really is. Normally you would think rights would go to the genetic parent since they are in the picture.

In a weird way, it kinda proves equality with everyone else. I mean, how many kids have fucked up lives because their parents are total retards? Now we've just got more of the same and maybe a slightly higher demand for chain wallets in bridal registries.

This area of the law in many states is decades behind. Hell most states are still trying to work out surrogacy issues much less parental rights between same sex couples. Absent direction from legislatures courts are going to have to figure this out. It's shitty because there's kid's involved. Regardless of whether you agree with same sex marriage, family law needs to catch up.

No kids and samesex couple separations could be handled by contract law. Oops didn't get that in writing Adam and Steve tough.

Going to disagree with you C_J. I'm not saying they are all rolling in dough like a class-action shyster, but I've never seen an attny have a hard time paying back those student loans.
