In most states he is required to notify the tenant first, but once the tenant moves out the rules can change.

A landlord in CA has the right to enter any unit during the day at reasonable hours. We enter apartments all the time when trying to track down a water leak. We always knock first, if no one is home, we use our master key and check it out, if someone is there we ask if we can come in and look. If they are busy we ask if we can come back at a later time, but the tenant cannot deny access forever, they have to let you in ASAP. We have even been pressed by the fire dept. to go into each unit every few months and check smoke detectors wether the tenant wants us to or not.
As far as the tenant moving out, if they said they would be out on the 20th, and they are gone, it would seem fine to go in and begin work. She should get back her deposit (or a portion as is the case sometimes). We have found that if the place was not kept up on a continual basis, no "coming in and cleaning some more" will help. It is funny how some tenants live like slobs for years and then
try to clean the place up the last second. It never works. If you take care of the place and keep it clean all the time, you SHOULD get your deposit back.
