Judge orders cross removal


The controversial cross on Mt. Soledad was deemed unconstitutional by a federal judge in San Diego on Thursday, meaning the cross could come down within the next few months.

A federal judge issued an order declaring the 43-foot Latin cross violates the Establishment Clause of the Constitution and unlawfully endorses one religion over others.

The cross, part of the Mt. Soledad Veterans Memorial, was challenged in 2006 lawsuit by the Jewish War Veterans of the United States of America and several local residents, all represented by the American Civil Liberties Union and the ACLU of San Diego & Imperial Counties.

In 2011, the 9th Circuit Court of Appeals ruled that the cross violated the First Amendment. The U.S. Supreme Court declined to hear the case, and it was sent back to federal court in San Diego, where Thursday’s order was issued.

The order states the cross must be moved within 90 days. If there's an appeal on that ruling, the process could be delayed.

<me>Cross has been up since 1952 and not one Korean war vet has complained...only the ACLU and the other Atheist.

It's a Korean War memorial. I could see it from the front yard of the house where I spent most of my youth. I can see it from my office right now.

It's always been a familiar sight to me. When I was in high school (graduated in 1975) our choir participated in an annual Easter sunrise service there one year. (Yes, public high school.)

If a Christian symbol upsets him so, perhaps his time would be better spent on therapy? Atheists don't get all that bent about crosses and stuff. It's the anti-Christ crowd that is getting all twisted into knots in their rage against God.

Might as well remove the crosses that sits atop of many soldiers' grave. God this is so fucking ridiculous. I would have put up a concrete reindeer and manger scene. Then it's part of the seasonal decoration.
