Murder is the killing of a human by another with malice aforethought.
There are different degrees, like pre-meditated.

There is also manslaughter which is less serious

There is "justifiable homicide", such as self defense or an execution.

There is "negligent homicide" where an act committed or ommitted contributed to a death.

They are all "homicide" which is the killing of a human being by another.

Not in your home in California.  
In CA it is presumed you are innocent if you kill an intruder (non family member or does not live in the home) in your home.

And you guys thought all CA laws were fucked up.
