I have an employee of middle eastern ethnicity threatening to file suit because (he is a 90 day probate employee btw) he is forced to have the day off on a holiday that is offensive to him and can't get paid for it because he is a 90 day employee...
He even threatened me the he would retain a lawyer if I didn't pay him holiday pay AND apologize for Christmas offending him. |

Tell him to go for it. If it is company policy that probationary employees do not get holiday pay, then it was condition of his employment. Sorry about his luck.

A long as that day is a scheduled shutdown day I wouldn't
think that would be a problem. When I worked in a facotry, that was our scheduled maintainance shut down time. I'd encourage him to waste his money on a lawyer. |

I couldn't believe this guy, I told him to shove it, and if he wanted to retain a lawyer for 4 hours of non worked pay (he's part time), go for it, the big boss has billions to spend on attorneys, I'm sure it'd be taking candy from a baby.

Tell him it’s a Federal Holiday, I’m not a Christian and a day off never offends me. As for apologizing tell him to apologize to you for September 11. When he say’s he had nothing to do with that tell him tell him you have nothing to do with Christmas being a company holiday.

LOL I would also let him know that his services will no longer be required prior to his probation period ending. |

Being an ex-HR guy myself, I will tell you something we learned.
"While they are on probation, they are better than they will ever be." This is a sign of things to come. Fire him immediately. |

Will not be a problem, if it's an "at will" state. Probation means "we're looking at you and may fire you for any reason". They just got a reason. |

I disagree. He is in the RIGHT country if he plans to sue everyone for every little grievance and get rich by doing so. In the middle-east, he'd be shot in the head for even considering such an obsurdity. |

He barged in my office again, saying he called his relatives and they all said it wasn't fair that he wasn't getting holiday pay He called me a "racist fuck" for not honoring his holidays as well him: "You'll be hearing from my lawyer" me: ::sips coffee:: watch your step out the door, you are no longer covered by workers comp insurance I really want to kick the manager who hired him and wasted a $32 drug test in the nuts right now. |

I might have said, you agreed to the policies when you started to work here. They WERE explained to you. You have no legal recourse. Besides, you could come to work on Christmas Day if you wanted to, but the building would be locked up tight and that's that. Amazing hypocrisy...he protests that he's forced to take a day off for a holiday he doesn't observe, and then he bitches about not getting paid for it? What a piece of work! The first sign that a company is starting to go down hill: When they have a department that's actually titled "Human Resources" or "HR". That's a bad sign. When they circulate a genuine written sexual harassment policy, it's a VERY bad sign. When they start objecting to your computer's desktop wallpaper, and it's not offensive to any sane human being, it's time to GO. Particularly if it's gun porn. CJ |

I dunno cm, a company this size couldn't operate without an hr department to handle payroll, benefits such as 401k administration, insurance, associate relations etc. It's not all just whacking people who don't follow policy.

It would not surprise me one bit if this entire situation, especially his termination, was manufactured. You were manipulated.
His lawyer will be a relative. They will settle out of court. If they do go to trial for a wrongful termination case, the liberal-minded idiots on the jury will find in his favor (no skin off their noses and your employer has deep pockets). Either way, he will get some money and not have to work for it. |

I agree that HR attracts the lowest intellect in corporate management. No offense to OP. Not alol bad. FWIW, I haven't seen anyone, anywhere I have worked in the past 12 years who worked in HR that wasn't a woman or a queer. Figuring out where that has led us doesn't take a lot of contemplation. |

Is he a citizen? Can ya get his dumb ass deported? Hell, I'm not Christian, don't observe Xmas, am forced to take 3 days off, no pay, while the plant is closed. I grumble about it a bit, and carry on. I'm not complaining to management or threatening to sue. Just the way it is, being an religious minority.
