Well, the law has been in effect for a while...have there been any local challenges or test cases involving the Peace Officer's Protection Act?  I am particularly curious about extreme antigun jurisdictions like Chicago, NYC, DC, etc.

I usually try to carry on a permit, but if there is no permit available I carry under HR218.

I know of several incidents where officers were contacted, but that is about it.

None of the LE publications we receive at work have mentioned any arrest.

Problem here in PRNY is there is no way afforded to qualify once you retire, hence you cannot be in compliance. These socialists here are so sneaky.

if you retire and move to a free state, you can qualify.

rumor is that rockland county is about to or has started qualifing people. that have at least their permit

The problem with test cases for HR218 is that even without that law, probably in the area of 99% of officers would not make an arrest of another officer for carrying anyway. Then you toss in a federal law that says you can carry anywhere, even the officers that would be inclined to make an arrest before HR218, won't likely do it now for fear of doing a lot of paperwork for a losing cause.

Also, the same law that he would be arresting for would also protect him from carry laws. Why would he bite the hand that feeds him? I know that some officers are idiots but to arrest after HR218 would be a real stretch.

I just think it is going to be hard to find an officer that arrests another officer for off-duty carry in light of the law.

Having said all that, I know that there are officers out there that are so self-righteous that they will make an arrest anyway.

I never looked at the retired section, but does it limit you to what state you must qulify in??

If it does, we still have some Chicago guys come out once a year for a golf tournament and get qualified.......

You have to qualifiy in the state of your residence, to that state's standard.

The way I read this: (in dealing with retired officers)

`(B) a certification issued by the State in which the individual resides that indicates that the individual has, not less recently than one year before the date the individual is carrying the concealed firearm, been tested or otherwise found by the State to meet the standards established by the State for training and qualification for active law enforcement officers to carry a firearm of the same type as the concealed firearm

That: Since I have moved to another state after retiring, can quaify, in my new state, simply buy having a cert (present state) LO range office, quailfy me, using my (state I retired in) State's (departments) qualification course.

I think, to be covered, it would be best to quailfy twice, once in the state in which you reside, and your old state.  I think you would be covered.

JMHO and like others have said, who is gonna get that pushy, and what prosicutor would attempt to prosicute you.

I think you're making it too complex, myself.

All of the red above appears to apply to the same State.  

(But I'm not a lawyer)
