last week i got into a minor (if even that) bumper bender. of course i was the car behind the one that was minorly damaged so i get the blame. i gave the guy my information and he didnt give me his. he goes on about cash and going to a dealer to get a price so we could do it without insurance and im thinking he just wants my money. his wife calls two days later and gives me a quote of 700-1000 dollars. i said i cant and to give me their information so i can just do it through insurance. she gets all defensive and doesnt give me any information. then this morning the insurance ppl from some company (i forget) call me up and leave me messages. any ways of getting out of this with my insurance company?

 No accident report, no accident. The only money he will get is what he gets out of the kindness of your heart. The accident report would have covered you in case he claims every dink in the car is because of the accident. On the other hand, if no accident report exists, there is no proof an accident ever happened and he might have gotten your info from sifting through your trash.

well the insurance lady asked for my policy number. the thing is-i gave these fkers all my information. its when i asked for theirs (which i shouldnt have to) that they refused. by the way- the guy i hit spoke "decent" english. his wife was the one who called and im wondering if these ppl even had insurance to begin with or if he was an illegal that was driving without a license (which would explain his shitty driving)

No police present? Why did you give any information? So now you basically admitted guilt. Should have called the police.

I'm no lawyer, so I don't have much that I can suggest.

hate to say it but the insurance is the worst part of an accident. they don't do a dam thing for you. they wait to see what the other guy's gonna do. (been there, done that)hinking.gif

In souCal, local PD and CHP generally WON'T come to take a report on a non injury accident, unless one vehicle needs towing.

He's the car to the rear, generally, he's the guy who's going to be paying, or at least his insurance is.

Your insurance company will provide a lawyer for you.  Don't bother asking them to do so until his lawyer contacts you.

Make some notes, don't do it in a diary, just make a folder, date it, and put everything you can remember on the papers, time of day, what he said, confition of car, everything.

You'd be surprised how long this is going to take, it'll be nice if you're sitting for a deposition in 1.5 years and you recal everything because you have the notes.

Don't worry, that's why you paid for the insurance.

Oh, one more thing, don't be surprised WHEN you hear he claims to have been injured.

well so far theyve tried to only get my money. ive obtained quotes for the damage they have and the quotes are all 1/2 of what theyre asking for. i guess weremy insurance agent and i) going to go and say that they never gave any information and that they tried to get a really high amount of money out of me. its really shady that his Wife called me...then their so called insurance agent calls and asks for information that ive already given them. they never filed a report-only tried to get cash.

I recently got rear ended.  

I was on my way to work, having a rotten day anyway, and this guy come hauling up behind me in an SUV.  He was able to slow to 5-10MPH before he crunched my bumper.  I was shaken, irritated, and trying to get to work ontime, and didn't handle it well.  He offered to do it outside the ins. co. which I was smart enough to be non-committal about.

I wasn't smart enough to make a police report, however.

Fortunately for me, the guy admitted what happened and didn't screw me over.  

So his ins. co. paid for it, but there was still an estimate given to me for the cost of the work to be done, something around $400.  Ok, whatever.  Due to several problems with getting a non-defective bumper the final cost was over DOUBLE ($826) that, plus the rental car @ $23/day--and I was in that car for almost 2 weeks b/c of the defective bumper issues.  When it was all said and done, I'm really glad I didn't accept the guy's offer to take care of it on the side...it would have been a big mess.

Never ever ever ever ever settle an accident that wasn't your fault without the cops and ins.

Much as you hate to do it, get your insurance company involved and have them handle it.  Sounds like they are just trying to jack you over for some extra bucks.

You may even skate, what are your state laws on having insurance and a drivers license?  If he wasn't insured or licensed in accordance with the law, you might not have to pay anything.
