I'm hoping that the collective Arfcom membership can give me some advice.
I have had an Indiana state-issued firearm-related personalized license plate on my vehicle for a few years now. I recently applied to renew it and was denied. The rules for exclusion include anything vulgar, drug or alcohol related, derogatory, or violent. They denied my plate on the grounds of violence -- and my plate just states a particular model of Colt firearm. I filed an appeal and wrote my state governor and the NRA. I received notification today that it has been denied for a second time, and that the Bureau of Motor Vehicles has dropped all firearms-related personalized plates. Anyway, what kind of legal recourse do I have? |

Your legal recourse depends on how much discretion your legislature has given the Bureau of Motor Vehicles in your state. If the rules for exclusion you listed are codified, I'd say you've got a chance. If they are not, then it is likely that Indiana law grants the BMV discretion, in which case you're probably SOL.

your legal recourse depends on how deep your pockets are. i'd say, take the 15K that yoru lawyer is going to need to fight this, and buy an M16 instead. |

From the BMV website:
PLPs allow creativity however, under Indiana Statue IC 9-18-15-4 (b) the Bureau may refuse to issue a combination of letters or numerals, or both, that carry a connotation offensive to good taste and decency, or would be misleading. Your PLP request is considered unacceptable if it is: 1. Offensive or has an explicit sexual connotation 2. Defined in academically accepted dictionaries including, but not limited to, Webster's Unabridged Dictionary and the Dictionary of American Slang as being: (a) A vulgar term (b) A term of contempt, prejudice, or hostility (c)An insulting or degrading term (d) A racially degrading term (e) An ethnically degrading term (f) An alcohol related term, including specific alcohol drink names and brands (g) A drug related term 3. A term recognized as a swear word or considered profane, obscene or repulsive; or incites lust or depravity Your PLP application and/or appeal are evaluated for compliance. |

I have no idea about legal routes for ya . If it were me I would keep pushing the issue . Contact your local state rep , and dont stop . Sounds like some one new got the "editor" job or they are using a word program of some sort . |

I say you apply for the A55ORGY plate and see if that makes it through.

My state would not let me have VTECSUX on my plates becuase sucks is not a nice word our how ever thier stupid ass wanted to explain it.

Uh...the code they cite, and what they printed don't jive.
IC 9-18-15-4 Applications; letter and number combination restrictions Sec. 4. (a) A person who applies for: (1) a personalized license plate; or (2) the renewal of a personalized license plate in the subsequent period; must file an application in the manner the bureau requires, indicating the combination of letters or numerals, or both, requested as a registration number. (b) The bureau may refuse to issue a combination of letters or numerals, or both, that: (1) carries a connotation offensive to good taste and decency; or (2) would be misleading. That's all it says. |

A guy in ohio got his plate, then they recalled it ,and made him turn it in 3M TA3 was the number. DMV must found a mirror.

Yeah, you don't find senators like him everyday. Even though he hails from my hometown with a population of slightly less than 15,000, we've never met. He's been a state senator since 1995. I'm going to owe him big time if he can get this decision reversed.

Oh yeah, Brent Steele is also the one who got the law passed here in Indiana last year that makes it a felony to protest at funerals: March 3, 2006 INDIANAPOLIS — Gov. Mitch Daniels signed a bill into law yesterday that makes disorderly conduct within 500 feet of a funeral a felony offense — putting Indiana among the first states to enact a law in response to a Kansas-based group that protests military funerals. Lawmakers and Daniels wanted to enact the new law ahead of a possible protest at a funeral March 6 in Kokomo for Army Sgt. Rickey Jones, who was killed last week in Iraq. “That family’s gone through enough already,” said Republican Sen. Brent Steele of Bedford, the bill’s sponsor. “It’s nice to see it’s in effect right now.” Daniels’ action came less than two hours after the state Senate voted 48-1 to give final legislative approval to the bill. Daniels had said he wanted to sign the bill as soon as possible. “Indiana respects the First Amendment, even for the most despicable forms of speech,” Daniels said earlier this week. “But equally, we’re determined to protect the bereavement and honor the sacrifices of those who’ve done the most important public service at all. That bill’s not going to reach my desk — I’m going to sign it at the front door.” Senators applauded when Lt. Gov. Becky Skillman announced the bill signing. Steele thanked legislative leaders for putting the bill on a fast track. “I have heard from thousands of Hoosiers on this issue and they almost unanimously feel this is the right thing to do for the families of our fallen heroes and the funerals of all Hoosiers,” Steele said. Steele proposed the new law after a protest by members of Westboro Baptist Church at an August funeral in Martinsville for a soldier killed in Iraq, during which the marchers dragged U.S. flags on the ground and shouted insults at soldier’s family members. Small groups from the Topeka, Kan., congregation, which is made up largely of the founder’s family members, have since protested at other funerals for servicemen in Indiana and have done so in several other states, claiming that soldiers are dying in Iraq because the United States harbors homosexuals. Disorderly conduct within 500 feet of a funeral, burial, funeral procession or viewing in Indiana is now a felony offense punishable by six months to three years in prison and a $10,000 fine. The Westboro Baptist Church has vowed to challenge funeral restrictions in court, saying they violate free-speech rights and target a church’s religious beliefs. |
