Police Say Dead Snake Used As Assault Weapon

POSTED: 3:22 pm EDT August 24, 2004
UPDATED: 4:04 pm EDT August 24, 2004

CEDARVILLE, N.J. -- In this case, police say the dead snake was more dangerous than the live one.

A Cumberland County, N.J., man, who police say reacted with drunken rage when his 6-foot black snake was stepped on and killed, used the dead reptile to whip its killer.

Kenneth Davis, 42, was charged with simple assault, Port Norris State Police Sgt. Sean Day told The Press of Atlantic City.

The dispute started when Davis tried to let his snake into a house on Sunday, and the resident's father stomped on it and hit it with a piece of wood, police said.

An irate Davis pushed the father, whose name was not immediately available, then whipped resident Michael File, 26, with the dead reptile. Police said File, who was shirtless during the attack, sustained small cuts and lacerations on his back.

File then grabbed a baseball bat and took aim at Davis' head, police said. Davis was treated for head lacerations by the Cederville Rescue Squad.

Day said charges against File are likely.

Police said it was not clear how Davis and File knew each other or why Davis released the snake in the first place.

Davis is the bigger moron. Let a snake loose in my house, the snake won't have anything to worry about until I'm done with it's handler.

Especially if it is caught on film.

I've always thought that we need 'blunt object' control. Ever notice how many assaults and murders there are with blunt objects?

"Hey Lenny, looks like your murder weapon here. I've got blood and hair on this blunt object".

Why do you need a blunt object? They have no purpose except for killing as many people as possible in the shortest amount of time. We must do it for the safety of the children.

This baffles me.  File, the victim, may be charges for defending himself.  If this was NYC, NJ or CA it would make perfect sense to punish the victim...but we're talking about Arizona here.  Don't they normally buy you a beer and give you a few free minutes at your attacker once he's all healed up and handcuffed?

This post is just beating a dead snake.

Guess ole Kenny is pretty lucky that NJ has strict gun control.  Try that in CO. The dead snake would have ended up stuffed into the exit wound.

Here's what's funny though, if the snake had been a dog, everybody would sympathize with Kenny.

Oh durh.  I forgot to go back and reread.  It is New Jersey after all.

In that case, jail the victim and throw away the key.  It's what he deserves for not waiting for the proper authorities to come to his aid.
