it has nothing to do with whats on the sign it the fact they didn't get a permit to reface the sign.
same thing happened to my pizza hut. we got a new logo, had a new sign installed. like 4 months later the city comes by and tells us to take it down since we didn't get a permit. had to get a permit to put the same sign back up. |

The page from the OP left me confused on what exactly is going on so I'm trying to learn more. I found NCMC 18.11.100 to see what the sign permit law says. (Link)
From there, I eventually found the section SIGNS AND OUTDOOR ADVERTISING DISPLAYS, which is a bit wordy. The problem here seems to be that a permit and approval process is required for erection of all signs in the area. However, I read the entire muni code and I can't find anything that would make the sign a violation. In the citation, they use "18.47.220 Removal from abandoned site or building." which seems to have fuck-all to do with Ares putting up a new sign for their new business. So really, other than not going to someone and begging for their permission, I don't know why the city is cramming sand up it's own vagina. Maybe they are intimidated by the silhouette of a gun? |

I would go to the sign company and ask for other similar jobs they have done. It other signs were changed without hassle from the city, a good case might be made that they are being illegally targeted due to the nature of the business.
Civil suit against thecity then follows... |

I just read the citation, and I am afraid Ares has no real fight.
The sign was abandoned after the previous tenant left, and for future use the sign needs to be brought up to code. I deal with stuff like this all the time here in Florida. People buy a house and try to make changes to it and will find out they can't because of code changes. They always think they are "grandfathered" in, and 95% of the time they have to go in front of the County Commissioners, and usually lose. Code enforcement sucks, but writing them a letter as Ares did certainly won't help their cause. Militant a-holes usually get blackballed trying to strong-arm their way with .gov workers. 18.11.090 NONCONFORMING SIGNS A. Nonconforming Sign Regulations 1. In cases where the area of signs existing as a lawful nonconforming use on a property exceeds the total allowable area for permitted signs, no additional signs shall be permitted on the property. If the size or configuration of a parcel or building is changed by the subdivision or splitting of the property or alterations to the building or parcel, property identification signs and outdoor advertising signs on the resulting properties shall be required to conform to the sign regulations applicable to the newly created parcel or parcels, at the time such change becomes effective. 2. In the event a use of any site or building is vacated, terminated or abandoned, for any reason, for a period of more than one ninety consecutive days, the owner or person in possession of the property shall be responsible for the removal of all signs on the property, building or wall, or for having the copy thereon painted out, immediately upon notice from the City. 3. Nonconforming signs shall be removed or made conforming when the business or property changes occupancy or ownership. 18.47.110 ROOF MOUNTED SIGNS. Roof-mounted signs are not permitted. In the appeal by Ares Armor, it says the sign was originally put up in the 1920s, before the current city code went in to effect. This sign is grandfathered and resurfacing the sign is not supposed to change the grandfathered status.
