U.S. District Court

Former Officer Pleads Guilty to Gun Charges

A former D.C. police officer pleaded guilty to gun charges yesterday in U.S. District Court in Greenbelt.

Edwin Kennedy, 36, of Chesapeake, admitted to illegally transporting a firearm and having an illegal shotgun. According to a statement of facts entered in court, Kennedy found a shotgun in Washington last year while on duty. He then took it home, and with the help of his 15-year-old daughter, sawed off the barrel to 14 inches, an illegal length. Kennedy then took the illegal gun back to Washington, where he arranged for the D.C. police to recover it.

When Kennedy learned he was under investigation for the modifications, he purchased a different shotgun and cut that barrel down to a legal length. Then prosecutors say he took pictures of it and showed those to authorities as if it were the original shotgun. But he later acknowledged to authorities that it was a different gun. He will be sentenced in May.

Either he's a really dumb cop, or he's a really dumb journalist.

If he found "found" the shotgun, either keep it, or turn it in.  Why alter it, and then turn it in?  And then the whole thing about buying another shotgun and taking pictures?  He already turned in the other shotgun!

Now my brain hurts trying to figure this one out.

Maybe because that's another charge for the perp?  Take a legal gun, make it illegal, and the guy winds up with another charge.  His word against the "servant of the people."

Some more info...

WASHINGTON D.C. METROPOLITAN POLICE OFFICER INDICTED FOR POSSESSION AND TRANSPORT OF A SAWED-OFF SHOTGUN AND OBSTRUCTING AN INVESTIGATION

A federal grand jury indicted Edwin Francis Kennedy, age 36, of Chesapeake, Maryland, today for unlawful possession and transport of an unregistered and prohibited firearm, and engaging in misleading conduct in order to hinder the investigation of a federal crime.

According to the four-count indictment, in January/February 2006 Kennedy, a Washington D.C. Metropolitan Police officer, possessed and transported a Savage Arms Model 67 12 gauge shotgun (Savage Arms shotgun) having a sawed-off barrel of less than 18 inches, which was not registered to him in the national Firearms Registration and Transfer Record.

The indictment also alleges that on April 14, 2006, Kennedy presented photographs to officers of the Calvert County Sheriff’s Office of a different shotgun than the Savage Arms shotgun with the sawed-off barrel, as if the shotgun in the photograph was the Savage Arms shotgun, in order to obstruct the investigation of his unlawful possession and transport of a shotgun with an illegally sawed-off barrel.

Kennedy faces a maximum sentence of 10 years in prison followed by 3 years of supervised release for possession of the shotgun; 5 years in prison followed by 3 years of supervised release for transport of the shotgun; and 10 years in prison followed by 3 years of supervised release for engaging in the misleading conduct. Kennedy is expected to have his initial appearance in U.S. District Court in Baltimore sometime this week.

An indictment is not a finding of guilt. An individual charged by indictment is presumed innocent unless and until proven guilty at some later criminal proceedings.
