I've always been under the impression that the first "I'll Take it" response under an ad meant that person won the item for sale.

Upon rereading the EE rules, I see that there's no mention of "I'll take it" responses.

I come here to say this because I posted an "I'll take it" on a ad with an item that appeared still for sale, and then seller comes back and says said item has been sold.

So is it just up to the seller as to who wins the Item?

or does the first "I'll take it" win

What say you all?

Happens to me all the time.

Its lame, but apparently, the "its their stuff, their rules" rule applies around here.

The other buyer may have emailed or IM'ed the seller directly and came to terms before you posted "I will take it".  It happened to me a few weeks ago.

The first person to contact me and agree on terms "gets it".

I was communicating via IM with a buyer once, and someone else posted "I'll take it".
He didn't take it. The person I struck a deal with took it.

It's not a sale until buyer and seller have finalized on a deal.  Seller is in no way obligated to accept anyone's "I'll take it", nor or they required to go by time stamps, etc.

seller can choose who he sells to unless he puts in his ad "first to post here I'll take it, gets it ". This is actually a good thing as it allows sellers to avoid no feedback 1 post shitheads who make up 95% of the negative feedback and welch threads in the feedback forum.

Seller can sell or not sell to whoever they want, so an "I'll take it" posted in the ad in no way binds the seller.  As an occasional seller, I am very much in favor of the rules the way they currently are.

That didn't apply to this instance, all of the "I'll take its" were sent overnight. Seller had no chance to get to it.

It just happens. All is well!!!

I always sell to the first I'll take it by time.

Sometimes you get a email, sometimes a IM, sometimes right on the forum.

The weirdest crap always gets ton's of responses.

Sometimes I cross post items on other forums, so someone there might contact me first or vice versa.

If someone sends me an email or IM and we strike a deal, I do my best to update the original ad with a "Sold pending funds" title so there is no misunderstanding.

For me it's been who makes contact first. 

If someone sends a PM or email saying they'll take it 20 minutes before you post in the thread you weren't the actually the first. 

I always send a PM or email to the seller in the EE not make a post in the thread.

One of the reasons I brought this up is that i had been penalized on another form for not adhering to a time stamp deal.

Which drives the point home that it's important to know the detailed rules of every forum marketplace.

Why?  If a post is older I usually start off with "Is this item still available?"  If I end up going another route before I hear back it's not an issue.

Why would you want to suddenly back out?  Worst case if you post "I'll take it" and it's not sold to you is you don't get to buy it.  You've wasted the 10 seconds it took you to type the response and hit submit?   I don't understand the issue with the current system.

My perfect buyer follows the arfcom mantra "get both".

They post and then PM, or vice versa.

I usually lean to the PM, if there's only one method. The PM notifies me immediately,  initiates the conversation,  and shows sincerity and follow through.

I don't sell on here because this site moves too fast, but when I do sell on other sites, I usually get a dozen PMs asking for the item well before anyone posts an "I'll take it", so I sell to the first person who offers the quickest payment solution.
