When watching CNN they said the State Dep. or
some said that whoever planned these attacks,
if convicted, would probaly face the death penalty.

If President Bush said this was'nt just terrorism
but war,why would there be a trial?

Even war criminals get a trial, like at Nuremburg.

That's assuming they are captured in the process of making war upon them...

Well, they only get a trial if they get captured...that is, if they survive 500 kilotons of nuclear explosive going off over their heads.....at least, I would hope.....

Leftists are going to treat this as a "crime" rather than an act of war.

I agree with Newt Gingrich on this one -- "I don't want to bring them to justice. I want to defeat them."
