The so-called "official" thread is full of a lot of stuff that doesn't get to the point.

Is there a case of or cases of confiscation that doesn't involve illegal concealed/open carry? In other words, where someone,for example, evacuating but transporting in compliance with statutes?

If evacuating, what is a legal transport method?

And are there clear cases of rational people having their firearms illegally confiscated from their homes?

They took these guys guns not all guns.

Looks or in this case Sounds like they got caught open carrying. Still no hard evidence of mass confiscation or purpose door to door searches for guns. This is why you have more than one gun so as soon as the cops leave you are armed again

IIRC in LA open carry is legal, so how do you get "caught" doing something that legal?? There have also been several stories in the news about cops going to peoples houses and taking thier guns. Thats door to door confiscation.....

The best info I've been able to find shows, vaguely, that LA is an open carry friendly state. The problem is that when something is legal they don't normally have to write down laws saying it's legal. NRAILA law info does not say that it is illegal.

The video does actually show officers breaking and entering. Yet another episode of criminal wrongdoing.

All in the name of "public safety".............those guys in the mansion are now sitting ducks if the looters or thugs decide to come by and break in.........and the police just put them at a distinct advantage

Right to Keep and Bear Arms

The right of each citizen to keep and bear arms shall not beabridged, but this provision shall not prevent the passage of laws to prohibit the carrying of weapons concealed on the person.

§1796. Preemption of state law

No governing authority of a political subdivision shall enact after July 15, 1985, any ordinance or regulation more restrictive than state law concerning in any way the sale, purchase, possession, ownership, transfer, transportation, license, or registration of firearms, ammunition, or components of firearms or ammunition; provided, however, that this Section shall not apply to the levy and collection of sales and use taxes, license fees and taxes and permit fees, nor shall it affect the authority of political subdivisions to prohibit the possession of a weapon or firearm in certain commercial establishments and public buildings.

A. Illegal carrying of weapons is:

(1) The intentional concealment of any firearm, or other instrumentality customarily used or intended for probable use as a dangerous weapon, on one's person; or

(2) The ownership, possession, custody or use of any firearm, or other instrumentality customarily used as a dangerous weapon, at any time by an enemy alien; or

(3) The ownership, possession, custody or use of any tools, or dynamite, or nitroglycerine, or explosives, or other instrumentality customarily used by thieves or burglars at any time by any person with the intent to commit a crime; or

(4) The manufacture, ownership, possession, custody or use of any switchblade knife, spring knife or other knife or similar instrument having a blade which may be automatically unfolded or extended from a handle by the manipulation of a button, switch, latch or similar contrivance.

(5)(a) The intentional possession or use by any person of a dangerous weapon on a school campus during regular school hours or on a school bus. "School" means any elementary, secondary, high school, or vo-tech school in this state and "campus" means all facilities and property within the boundary of the school property. "School bus" means any motor bus being used to transport children to and from school or in connection with school activities.

Thanks. Off to breakfast. I'm still agitated over that video. Grabbing someone brandishing in a public place is one thing. Going into a home and taking the firearm of someone minding their own business should be a capital offense.

Sounds like there is no shortage of "good germans" in the NG and NOPD. It would be good to see a resigned PO on the air railing against illegal confiscations.

Did you miss the part of the video where they said "Instructions to disarm anyone inside" and "No one will be able to be armed, we will take all weapons?" Or that part of the video where they said "street by street, house to house"? I'd say that's all the hard evidence you need.

Yes they took these guys guns, but they're in the process of getting all of them.

Sounds like time to go to court! Granted it doesn’t do the poor souls any good at this time, but as the saying goes, "Pay back is a mother #$%*." The numbers could go high, official oppression, home invasion, theft, and violation of civil rights. One could only wish! This will be thrown into state court and given the gun sales in the rest of the state the public officials are going to get an a*! kicking at the ballot box. Keep in mind the voter base in NO is now in other states.

In one of the other threads, I posted links to the relevant Louisiana statues the allow the Governor, in times of emergency, to restrict the sale or transportation of firearms. Under those statutes, people who are found carrying in the streets could be stopped. But there is absolutely no legal authority for going into people's homes and confiscating their firearms.

B. For purposes of this Section, "firearm" means a shotgun or rifle, or a pistol, revolver, or other handgun.

C.(1) For a first offense, the penalty for theft of a firearm shall be imprisonment with or without hard labor for not less than two years nor more than ten years, without the benefit of probation, parole, or suspension of sentence and a fine of one thousand dollars.

(2) For a second offense, the penalty for theft of a firearm shall be imprisonment with or without hard labor for not less than five years nor more than fifteen years, without the benefit of probation, parole, or suspension of sentence and a fine of two thousand dollars.
