This is why our great nation is going down the crapper. Just on the O'reily Factor-I saw it with my own eyes-a California Congressman said that possession of child porn should not be a felony. How do people like this get into positions where they are responsible for making laws? What a sick, twisted bastard.


And you wonder why folks like that dude in Washington who killed the two child molesters are taking the law into their own hands??

Isn't MAKING child porn a felony also? So if making it is, why is there a problem with possessing it being a felony? Making it or possessing it, you're just as guilty.

BS, the child porn buyers drive the crime to happen in the first place (IE:movies, magazines and stills)
With no buyers the market would dry up and disappear.

I do not believe you have ever met or even heard of the majority of California polititians. Yes we have some really fucked up ones, but we also have some of the most Conservative, honest, patriotic polititians in the Nation.

As we explain in our petition, certiorari is warranted in
this case because the court of appeals invalidated two
important provisions of the Child Pornography Prevention
Act of 1996 (CPPA), 18 U.S.C. 2251 et seq. In particular, the
court of appeals held unconstitutional the provisions of the
CPPA that define child pornography to include (1) any visual
depiction that “is, or appears to be, of a minor engaging in
sexually explicit conduct,” 18 U.S.C. 2256(8)(B) (Supp. IV
1998), and (2) any visual depiction that “is advertised, pro-
moted, presented, described, or distributed in such a manner
that conveys the impression that the material is or contains a
visual depiction of a minor engaging in sexually explicit
conduct.” 18 U.S.C. 2256(8)(D) (Supp. IV 1998). Certiorari
is also warranted because the court’s holding is incorrect and
conflicts with the decisions of three other circuits, United
States v. Hilton, 167 F.3d 61 (1st Cir.), cert. denied, 528 U.S.
844 (1999); United States v. Acheson, 195 F.3d 645 (11th Cir.
1999); and United States v. Mento, 231 F.3d 912 (4th Cir.
2000).

Not to sound like a perv here BUT, there was a reason why this part of the law was struck down. It had to do with vagueness of the wording. is, or APPEARS TO BE, of a minor engaging in
sexually explicit conduct This is at worst extremely dangerous wording when it come to Legal porn and overzealous DA's. According to this law you MIGHT be arrested for possession of mags like "barely legal" or "cherry poppers" or "First timers" or whatever! So suppose you got a flick where an 18 or older girl is dressed up in that "catholic school" uniform, and doing things with the headmaster well according to the law you could be arrested for "simulated" (whatever the hell that means) child porn.

And if that isn't enough of a clue for you, his website calls him the first openly gay Representative and he was the Chair of the LGBT (Lesbian, Gay, Bisexual & Transgender) Caucus in 2004.
