Remember, Duncan was remanded from the SCOTUS in light of Bruen and 9th Circuit has begrudgingly accepted that they have to follow Bruen as well else face the wrath of SCOTUS. Duncan has won once and it will win again while the appeals court is on notice that if they purposely disregard higher decisions, its not going to go well for them.

Today is a good day. This news is welcome in our fight to regain our rights, for those of us behind enemy lines. Im not one that usually believes in good signs, but there is this news, one of my best friends got good news on a CT scan for their cancer fight and my new credit card came in, as if it was saying prepare yourself to buy magazines. I'll take any good news I can get....and today was good news.

Last time a 3 judge panel upheld the ruling striking down the ban, but the full court reversed it. It was then appealed to the Supremes and was waiting for Bruin, then sent back down after Bruin. The 9th should have reversed their decision, but they sent it back to the district court to stall. |
