I have family (father in law) who will be visiting St. Croix from North Carolina.  Is it legal for him to possess and carry his concealed weapon while on vacation (he is a legal CCW permit holder in NC) in the USVI?  Couldn't find any information on the VIPD, or on the Atty General's website.



Tried Google search and the few things I found were from 2008 and iffy on the subject.

The VI PD website does have information on it and I reviewed their laws but it looks complicated.  My understanding was that you could possess your gun there if you have a carry permit from the states but you can't walk around with it.  You'll probably have to break down and call them.

Especially when more than 50% of people on a gun website appear to oppose mandated reciprocity.

No, he can't. That's the short answer.

Also, there are forms he must fill out and get approved from US Customs if he wishes to take a pistol or a rifle, but not a shotgun, out of and back into the US. If he attempts to bring the weapon back with him and he has not done this then he can and will be charged with weapon smuggling, even if he can prove the weapon was purchased in the US.

Furthermore, he can be charged with unlawful posession of a weapon while in the USVI. It is the law that anyone bringing a weapon into the USVI must notify the police upon arrival, which will initiate a shit storm.

I strongly suggest avoiding legal entanglements at all costs, especially cross border legal entanglements.

Or if someone would argue Full Faith and Credit to the SCOTUS and have them lay the smack down we won't need another law that could be repealed in the future or set standards which take away things like Arizona's constitutional carry or VA's open carry.

No legal expert here, but I'd be surprised if, even in the event of federal CCW reciprocity law, that it would necessarily apply to non-State US territories.

There must not be a jail/prison in the USVI.  On that site, there is a section showing pictures of people on house arrest.  There are two guys, one for murder and another for rape/robbery, that are on house arrest.  Wow.

Cancel my last, there are a bunch of them for murder that are on house arrest.

Good luck in USVI. They might approve your paperwork by 2018...The government is incompetant, and more left wing than anything close to DC or New York City, or Chicago, if that puts it in perspective. To sum it up, ONLY criminals and corrupt police have guns and carry them in the Virgin Islands. And it's always nice  when you are sitting in a waterfront restaurant and a black posse comes in pointing guns and demanding a wallet throw down. The cops might arrive a half hour later, if nobody is shot. Take a couple of Kimber pepper spray "guns" instead. That's about all you can do.

If he qualifies for HR218 LEO CCW then he can carry, IIRC.  If not LEO, remember USVI is basically another banana republic...

Other thing is that even if you are miraculously granted right to carry in the VI, and you actually have to use it, you will be severely disadvantaged against the VI government's case against you. Especially if you are 1. White  2. From the continental US.  Not worth it.
