Police were called to a "major accident" on the interstate about 2:15 a.m. When they arrived, they found two people suffering bullet wounds, laying on the freeway several yards apart, police said. As two officers were trying to help the victims, someone fired on them, striking Cpl. Jerry Poston, a 17-year veteran of the force, police said. As Poston's partner frantically called for help, several passersby stopped to assist. They, too, were fired on. One of those passersby returned to his car, grabbed a handgun and shot down the suspected gunman, police said. Poston was listed in serious but stable condition at Methodist Central Hospital in Dallas, police said. Detectives remained on the scene late Sunday morning, still trying to sort out exactly what happened and identify the people killed. All were men, they said. Police also said they recovered a shotgun at the scene. Southbound I-35 remained shut down between Oak Lawn Avenue and Colorado Boulevard at 8:15 a.m. Sunday. I hope the officer recovers, but that is a great story from a CCW stand point.

While on one hand it is a good story......the CCW'er is very luck since I'm sure the responding LEO's were coming in looking for someone with a gun after hearing "shots fired" over the radio.
Its not a slam on the CCW'er as this type of situation is covered (by me) during the fireamrs training I give my officers. If your in plain clothes.......and have to act, you need to remember that responding officers may not know that you are an officer. Glad things worked out though. |

Lots of things. He could have been helping one of the accident victims, he could have been moving to or under cover. The CCW was probably being ignored by the shooter and was therefore able to get his gun and do what he needed to do.

Suspected gunman Let's see he shot a cop, shooting at another cop and citizens, but he's only suspected of doing it. I would like to hear a cop say, "He stoped to help me and put two to the chest, and the Bad Guy is down. |

I've got 10 bucks(I'm poor) that says even if this makes it to the mainstream media, no one will mention that a regular old civilian saved the lives of police officers and innocent civilians by retrieving his own firearm and shooting the bad guy. If it makes it to the major news outlets, I doubt that the civilian hero is even mentioned. Great story though.

Screw that. Somebody shoots at me, or my friends/family who are with me, I return fire. That's just how it is. I'm not going to sit back and "observe" them shooting at me/us, so that I can "report" it later. The BG's very next round might actually hit someone I care about, and I can't allow that to happen. |

I do not understand. If I am anywhere and I, or anyone, is taking incoming fire from a active shooter somewhere and I am armed sufficiently to deal with the situation then there is no way I am going to sit there and with a case of oh teh noes. I can not sit and watch innocent people die when it is in my immediate power to do something about it. Period. Much less when the shooter just gunned down an Officer in uniform responding to the accident. Heck no. |

I wouldn't be surprised if the media doesn't twist it around like normal to make the passerby out to be a gunwielding maniac responsible for the situation in some way or another and the DA throws some kind of charge at him.
Either way I bet they take his gun for evidence and he doesn't get it back for a while, he's harrassed by media and the police with alot of time wasted with unneeded questioning and paperwork in the end, and is sorry he didn't just keep driving. |

Not particularly, but fighting back sure beats dying as a result of doing nothing. Or watching my wife, or children, or friends die because of inaction. EVERY round sent my direction has a chance of HITTING me. Or someone I care about. I can't just sit back and allow it to continue on, while waiting breathlessly for the police to arrive, who are what, one, two minutes out? 30 seconds? A lot can happen in 30 seconds, and I intend to see it DOESN'T happen to me or mine. |

I think that the BG was found guilty of "Ag assault with a weapon" as well as "Ag assault upon a peace officer" and the sentence was carried out in situ by our unnamed good smaritan. |

I agree, and the responding cops should wait for swat to show up and observe and report what is going on also. You know, like in the majority of the massacres that have happened in the past. |

In this situation with one officer already seriously wounded and two other innocents already dead, engaging the shooter with lethal force was the RIGHT move. |

I would rather worry about the cops showing up than about the dimwit who is spraying bullets everywhere, including in my direction. Besides...if the police show up and see you and the other on scene officer shooting in the same direction, they will put two and two together pretty quick. |

There was one other officer present, Poston's partner. Poston's partner went to help the people already shot, when Sr Cpl Poston was struck the partner was also shot at, who grabbed some cover to make the radio call of shots fires, officer down. Jerry Poston took a 12 gauge to the face guys, he's lucky to be alive, and is now in good condition. |
