Archived [ARCHIVED THREAD] - CA6 US V O'Malley question

Just reading the CA6 opinion in O'Malley, Nos. 00-4365/5416, and I have a big question.
What is the deal with the illegal assault weapon that the store is not allowed to possess? The court does not say, even though they recommend for publication.
Anyone know? Whs it pre or post? Could it have been an LE gun?
