That you're subject to the UCMJ if you're getting any money from the Military and that's why Petraeus resigned. Uh, what?

Why?

Not why did he say that...

But why would you watch that dipshit?

He's an idiot. There is a very well known case regarding just this and that he is wrong.

Four star generals, I believe, remain subject to the UCMJ post-retirement. A fully qualified Sea Lawyer will be along presently, I'm sure.

EDIT: FWIW

Good rule of thumb is if O'Reilly's mouth is moving, he's either lying, or wrong, or moth.

You aren't a four star general when you retire, it is a limited time appointment.

He may suck, but if Wikipedia article is true then he is correct...

"Retired members of the uniformed services who are entitled to retirement pay are also subject to the UCMJ, as are retired reservists who are receiving hospital care in the VA system."

Military retirees are subject to recall (it is in the fine print). People who leave the military short of retirement and fulfill any inactive reserve obligations are not subject to recall. I do not know about UCMJ while drawing retirement benefits.
