FORT MEADE, Md. – An Army doctor who disobeyed orders to deploy to Afghanistan because he questioned President Barack Obama's eligibility to be commander in chief told a jury Wednesday he was wrong to do so and would now deploy if he could. Lt. Col. Terrence Lakin of Greeley, Colo. was speaking during a court martial hearing Wednesday at Fort Meade.



He faces up to 3 1/2 years in a military prison and dismissal from the Army after being found guilty of missing a flight that would have gotten him to his eventual deployment and pleading guilty to disobeying orders to meet with a superior and to report to Fort Campbell in Kentucky. He asked the jury to let him remain in the Army when it decides his punishment, and jurors are expected to begin deliberating on his sentence on Thursday.



"I don't want it to end this way," said Lakin, a 17-year veteran of the Army. "I want to continue to serve."

Commissioned officers

Commissioned officers cannot be reduced in rank by a court-martial, nor can they be given a bad conduct discharge or a dishonorable discharge. If an officer is convicted by a General Court-Martial, then that officer's sentence can include a "dismissal." This is considered to be the same as a dishonorable discharge. An officer convicted at court-martial, but not sentenced to a dismissal, can be dropped from the rolls, by the service Secretary. That is an administrative separation, not punitive.

What a crock, they can't have rank taken away and it is an administrative separation.  So if they get a dismissal it isn't considered a dishonorable as in the form 4473's and job apps etc?

A dismissal is having your commission revoked and is the equivelant of a dishonorable discharge, and this is exactly what this ass should get.

Dismissal is considered a DD and treated as such.





It's not an adsep.



It's a criminal sanction, a part of the sentence for the crime passed down by the court martial.



HOWEVER, if the Court decides NOT to dismiss him, SecArmy can still say 'get the fuck out of my Army', and adsep him (DFR).

Ahhhh, that makes sense.


The administrative separation 'option' is available to SecArmy in the event that a convicted officer 'beats' dismissal at trial....



Essentially 'Yeah, you convinced them not to kick you out. But not me. YOU'RE FIRED'...



That way, an officer who doesn't get dismissed by the Court can still be removed from the service, rather than going to prison and coming right back to work afterward...

Not a joke, but I don;t expect it to end well for him.  he's gonna get fucked.  But now he's gonna get fucked  AND look like a pussy.  He could have stuck to his guns and at least played it off as being  "A man of conviction" (No pun intended)

One needs standing to fight something in the courts.  He should have known better, though.  

If it were me, I'd have stuck to my guns.  He has nothing more to lose at this point.  Now, he just looks like a cowardly jackass instead of a good man standing up for his beliefs and his (misguided) understanding of his oath.
