So gangbangers in a drive by can be labeled terrorists and be held without trial as an ENEMY COMBATANT? So you can be declared an ENEMY COMBATANT and arrested cause your neihbor saw a bunch of guns and you post anti-govt rants on a website and the govt decides you COULD BE a threat?

No, you can't arrest a gangbanger as an enemy combatant. The guy in question was picked up on a battlefield in Afghanistan. The court quite rightly refused to get involved in second-guessing the military.

This is no different than a US citizen getting picked up fighting for the Germans in France, circa 1944. He doesn't get recourse to the US courts. He gets tossed into the cage with the rest of the German POWs.

It's about fucking time a US court recognized the battlefield authority of the US military. [;D]

You take up arms against the US on a foreign battlefield - you just gave up your citizenship and all the Constitutional perks that go with it you fucking dirtbag, ratass, MoslemMaggot-supporting shitstains!

I just can't believe this America-hating, GI-shooting, MoslemMaggot has actually clogged our courts through THREE fucking appeals. In America's younger and brighter days he'd have been shot or hung from a tree for treason long ago - IF he ever made it home from the battlefield alive.
