The argument that the mandate is a tax, and not a regulation of commerce, is also key to the Administration’s effort to delay legal challenges to the mandate, as taxpayers must first pay a tax and then seek a refund before challenging its constitutionality.






Just more cynical government power.   It's like delaying tactics.

If it is a tax it is UNCONSTITUTIONAL because it did not originate from the House of Representatives.



It started in the Senate. Passed. Then went to the House. Passed. Then went back to the Senate for the Reconciliation vote that everyone made a big deal out of remember?

Bills can originate in either the House of Representatives or the Senate.  What matters is that they pass a vote in both bodies before going to to be signed or votoed by the POTUS.

Nope, Revenue Bills can only originate from the House. Here's a refresher:










ARTICLE I



Section 7. All Bills for raising Revenue shall originate in the House of Representatives; but the Senate may propose or concur with Amendments as on other Bills.

Seems pretty unambiguous if you ask me. obunga is calling it a tax himself and the Internal Revenue Service is tasked with enforcing it. It didn't start in the house nor is it an amendment that the senate added to a bill that came from the house either.
