The 9th circuit has denied a rehearing of Silveira v. Lockyer. However, if you like to read legal opinions you must read the descenting opinions particularly that of Circuit Judge Kleinfeld. It is well constructed and touches on the inadequacies of the 'collective right' argument. It also lambasts some of his colleagues for ignoring previous Supreme Court decisions by which the lower court is bound.
