A standard signal flare device is not controlled, even here in Californistan. I know you aren't in Cali but you may find this amusing:
I am getting a great deal on one its a psuedo 203 type with mounts.... OTOH the Californistan Ministry of Justice thinks anything designed to mount on a rifle qualifies as a state "Destructive Device", even though the law doesn't say so, and won't allow them to be imported.  OTOOH L&G Weaponry manufactures one right here in Cali and will sell it to anyone by mail.  lgweaponry.com/ad_sheets/37mm.htm Here is the shoulder stock version, with an AR type collapsible stock:
