to transfer a smoke/flare gun do you have to go through an FFL or can you just mail it

I am getting a great deal on one its a psuedo 203 type with mounts....i am going to put it on an old mauser stock on it to make a m79 like smoke/flare gun......

A standard signal flare device is not controlled, even here in Californistan.  I know you aren't in Cali but you may find this amusing:

OTOH the Californistan Ministry of Justice thinks anything designed to mount on a rifle qualifies as a state "Destructive Device", even though the law doesn't say so, and won't allow them to be imported.  

OTOOH L&G Weaponry manufactures one right here in Cali and will sell it to anyone by mail.
