TRENTON, N.J. – A 14-year-old New Jersey girl has been accused of child pornography after posting nearly 30 explicit nude pictures of herself on MySpace.com — charges that could force her to register as a sex offender if convicted.

The case comes as prosecutors nationwide pursue child pornography cases resulting from kids sending nude photos to one another over cell phones and e-mail. Legal experts, though, could not recall another case of a child porn charge resulting from a teen's posting to a social networking site.

MySpace would not comment on the New Jersey investigation, but the company has a team that reviews its network for inappropriate images. The National Center for Missing and Exploited Children tipped off a state task force, which alerted the Passaic County Sheriff's Office.

The office investigated and discovered the Clifton resident had posted the "very explicit" photos of herself, sheriff's spokesman Bill Maer said Thursday.

"We consider this case a wake-up call to parents," Maer said. The girl posted the photos because "she wanted her boyfriend to see them," he said.

Investigators are looking at individuals who "knowingly" committed a crime, he said, declining to comment further because the case is still being investigated.

The teen, whose name has not been released because of her age, was arrested and charged with possession of child pornography and distribution of child pornography. She was released to her mother's custody.

If convicted of the distribution charge, she would be forced to register with the state as a sex offender under Megan's Law, said state Attorney General Anne Milgram. She also could face up to 17 years in jail, though such a stiff sentence is unlikely.

Some observers — including the New Jersey mother behind the creation of Megan's Law — are criticizing the trend of prosecuting teens who send racy text messages or post illicit photos of themselves.

Maureen Kanka — whose daughter, Megan, became the law's namesake after she was raped and killed at age 7 in 1994 by a twice-convicted sex offender — blasted authorities for charging the 14-year-old girl.

The teen needs help, not legal trouble, she said.

"This shouldn't fall under Megan's Law in any way, shape or form. She should have an intervention and counseling, because the only person she exploited was herself."

Called "sexting" when it's done by cell phone, teenagers' habit of sending sexually suggestive photos of themselves and others to one another is a nationwide problem that has confounded parents, school administrators and law enforcers.

Prosecutors in states including Pennsylvania, Connecticut, North Dakota, Ohio, Utah, Vermont, Virginia and Wisconsin have tried stop it by charging teens who send and receive the pictures.

In northeastern Pennsylvania, a prosecutor recently threatened to file child porn charges against three teenage girls who authorities say took racy cell-phone pictures that ended up on classmates' cell phones.

The MySpace case may be a first, though.

"I'm not sure I've seen a prosecution like this coming out of a social networking site," said Seth Kreimer, a constitutional law professor at the University of Pennsylvania.

Milgram, the attorney general, could not recall another such case in New Jersey. She cautioned parents to get on those sites and monitor what their kids are talking about and posting.

"Unfortunately, youth don't have the same judgment as adults," she said, "and often, adults don't have the same technical savvy as the youth."

I don't see any good reason to charge her with taking pictures of herself.  That just seems like nonsense to me.  Mom needs to kick the girls ass and maybe choke some sense into her, but charging her with child porn?

I agree the CHILD needs help but she's not a criminal.  

Child porn is illegal because of exploitation and abuse.  She made the decision to exploit herself.  Totally different.  

The legal system is just like the medical system––––––only worried about the symptom and not the cause.

Don't forget all the trouble she can get other people into. Some random guy happens upon her myspace before the pics are taken down, whoops just viewed child porn. And "it was an accident" doesn't usually work as an excuse for viewing child porn.

A liberal agenda starting in elementary school that teaches that "it's all good as long as it doesn't hurt anyone's feelings" So, we are shocked that kids do that? Did this child think for one moment that it would hurt anyone? Nope, hey her "role models" do it all the time and THEY get good press about it.

Also, it's a matter of degree. I'm 57 and yes, amazingly there were 14 year old sluts around. I understand they have been around like......forever. However with technological improvements the method of delivering the message has resulted in 1. The ability to communicate instantly. 2. The ability to report it globally, instantly.

In the past, you probably wouldn't have even seen it in your hometown newspaper, the decision being made that it only appealed to "prurient interests" as wasn't worthy of printing. Now, not so much.

ETA : There has already been cases of other teens being charged with it for "sexting". Taking pictures of themselves with their cellphones and texting it to someone, then it gets passed around, a lot.
I'm willing to bet that she knew what she was doing, it also violates the terms of service from myspace. Making her more likely to get prosecuted. I'm also willing to bet that she doesn't grasp the possibility of her consequences. Someone has to be the example.

And for some reason I think there's got to be some kind of constitutional issue in arresting someone for possessing nude pics of themselves.  I can't quite figure out how I'd argue it but I know it has to be there somewhere.

Give her something constructive to do with her time, community service and what not.  Take away her cell phone and computer access.  But a registered sex offender?  Ruin the rest of her life because she made a stupid kid mistake?  How many members of this site had sex with someone in high school while both parties were underage?  That would make a large portion of this site sex offenders by the logic presented in this thread.  So, any sex offenders out there?

That pretty much nails it on the head.  When I was a teen, young girls weren't acting like that (except for handful of cheerleaders, but that's a different story).  The pop culture of today is making them more brazen, bold and careless about the decisions they're making.  Many of the girls emulate Britney Spears, Lindsey Lohan, Paris Hilton, Christine Aguilera, etc.  If I flip this, it's also setting an example.  When young boys see those types of girls and the promiscuity of sex, they take the adult world and try to fit it into their teen world.  Boys will peer pressure girls into doing things... and the pop culture says it's ok to do so.  Technology certainly enhances and expedites this way of thinking....  it also prevents parents from knowing about it.  

It's the world we live in.  Sex sells in this culture and kids are buying into it.  Then again, it wasn't much different from the 80s when Madonna featured her song, Like a Virgin.  

I blame the parents for not educating their sons and daughters about the dangers of technology.  It's the same principle as handing over a gun.  If you do not properly educate them, they will use it in ways that it's not meant to be used and someone will get into trouble.

That is the part I do not get. How can you be charged with the possession of pictures of yourself, taken by yourself, on your own free will. That is just mind boggling. What is worse is there are people who see no issue with this cause its 'child porn'.

Well, I'm with you on most of it except.....

Private collections of photos are all well and good - "privacy of your own home" kinda thing. However, when you cross the line into public distribution of said photos, then it's another story.

Kids these days aren't doing a damned thing that anybody our age and older wouldn't have done if we had the technology.Don't tell me that if you were in 8th grade and the class slut sent somebody pics that you wouldn't have been pissed that you didn't get to see them.The bottom line is we're dealing with people who aren't quite adults making adult decisions but I don't think they should be punished as an adult for that.
 I have a hard time considering a girl sending pics of her boobies to her boyfriend on her cell as kiddie porn.Now,the real rub is that,because they ain't too wise to the way of the world, the boy ain't going to keep those pics to himself and in the click of a mouse they can be all over the innerweb and the girl doesn't have a clue as to how many people have now seen her goods.

 What technology has done I think is given kids a bunch more information than we had as teens and their brains and body chemistry aren't prepared to deal with it.I remember sneaking into my dad's closet and looking at his 70's Playboys in wonder but that's a looooong f'ing way from being able to get an eye and mind full of orgies and anal,and not being told any better,accepting that as normal human sexuality.If anything,sex ed needs to be far more comprehensive and realistic now but parents,people like us to be honest, don't want schools to do it and don't want to do it themselves it seems.

 There was a case locally a month of so ago where a 14 year old girl was charged for distributing child pornography due to cell pics.The DA said " I don't think it is appropriate to charge her with this but it's the only tool we have".I say that it is bullshit,the kid should just have been given counselling along with her parents and it would have saved the community $ and herself further embarassment for a really stupid decision. Those laws were meant to be used against those who would exploit children via photographing and filming child molestation and to charge a kid under the same law and punishment is simply absurd.What these kids are doing isn't very smart and I'm sure many of them are going to regret the living hell out of it later but I think that the lack of good parenting and education shouldn't be dealt with by charging kids with a very serious crime.

Remember kids, when it comes to racy pics, please send them to the right number. The last thing I need is a wrong number teenie porn pic showing up on my phone.  I can only imagine how they'd try to ruin my life if they're trying to fuck over a 14 year olds life by equating her with Chester the Molester who likes to touch little girls where they pee.

This is ridiculous. Holy shit, you are having natural urges because of your body's hormones so you photograph yourself and now we will arrest you? That is all kinds of fucked up. Everyone agreeing to it needs to have their head air between their ears examined.
you don't charge minors with crimes against their own bodies to put them on a sexual offender list for the rest of their life.
