Yeah, that will teach kids not to play like kids....
Do have to ask where the parents were on the protective gear? My kid, when he was 9 y.o., caught me headed to the mailbox with his MP5 airsolf. Fuck those things hurt in full-auto! He though it was funny as hell.

There are some folks that, if you tried to take their son from their house, the difference between assault with a deadly weapon and a kid shooting an airsoft gun would become painfully, overwhelmingly, and totally clear to a whole bunch of people.

To the OP: Do the courts have the DA's back? They offered the kid a plea down to misdemeanor assault. Again, WTF? The parents of the kid that got shot don't want to press charges. Will the court really prosecute or convict?

Lets review.
13 year old kid gets pissed at friend and intentionally shoots him in the eye with a plastic bb going 300-500 fps. I'd say something above and beyond an ass whupping is in order. Felony assault? Nah. The fact his friend ended up with no permanent injuries should make a difference. But in most criminal cases intent, not result, is considered. If this was just a result of kids being dumbasses, I would say no big deal. Kid shot his friend in the face in spite. He's 13, not 5. I would have been happy with him taking a ride around the block in the back of a cruiser. |

The kid chose to shoot his friend, hitting him in the eye, with a (6mm plastic) BB because he was mad at him. This is not an airsoft milsim or BB war. It is a boy using an implement that has the capability to inflict injury that can have devestating lifelong effects on another out of anger. That is UNACCEPTABLE behavior. What prompted him to do it? Maybe he has some underlying S-E problem or mental issue....or maybe he is just a punk that needs to be put through the system like any other punk. Next time, he won't write checks he doesn't want cashed. Slugging people in the face because your mad at them isn't acceptable. Shooting them isn't either.
