Here is the scoop:

My son was home Thursday evening doing his homework when his ink pen died. He asked if I had one he could have. I reached into the pen holder on my desk and grabbed a pen and gave it to him. He continued his homework as usual. The night passed normally, everyone goes to bed, and Friday rolls around.

So, my phone rings Friday afternoon. It's the vice principal from my son's school saying that he needs to discuss a serious situation about my son. When I asked him what was going on, he tells me that a pen bearing a Glock logo is forbidden by school policy and that I need to come and pick up my son because there is a manditory 3 day suspension because of the violation. Apparently, one of my son's teachers saw him writing with the pen during an assignment.

While I have the VP on the telephone, I retrieve my son's student handbook. Flipping though it, I see that weapons, replica weapons, pictures of weapons, and weapon images on keychains or other items are forbidden. The pen I had given him was one I picked up at a law enforcement firearms competition last year - which bore only the Glock logo, but not an image or rendition of a firearm. Nowhere does it say that a firearm company logo is restricted by school policy. I explain this to the VP.

So, the VP gets his handbook and looks through it. He was in agreement that the pen did not directly violate the policy, but that the Glock name was commonly known to be a firearm and therefore it technically was in violation. Then, the VP even makes a statement to the fact that I am a local LEO and I should know the proper application of the rules.

I found this to be the most hilarious interpetation of school law yet. I engaged in an argument for a short time about the suspension and how the pen did not violate the posted rules as understood by anyone reading it. The VP would not budge on his position and referred me to the school system's superintendant's office.

So, my son is at home and I have an appointment at the school superintendant's office tomorrow. I will try to be diplomatic, but this situation is clearly not covered by the rules by the VP's own admission. Maybe I am wrong here, but this just seems very unfair and exceptionally liberal.

How would you deal with this situation?

Take your kid out of public school.

Go to the principal, and register a grievance.

Go their meeting and raising holly hell.

Courts and sue them.

The principal was being a git and the school policy is moronic.  This is so utterly stupid.

how would *I* deal with the situation? well, i'd file this away as a lesson learned on how authority figures can fuck someone's life up over the smallest little nothing, and keep it in the back of my mind in case i ever find myself in a situation where i could do the same...

How the FUCK we went from having hunter safety courses in school, which sometimes included bringing an unloaded rifle to class... to banning even somuch as a BALLPOINT PEN with a gun makers NAME on it... is just beyond my comprehension.

I can remember bringing automotive wheel weights to school so we could melt them down and cast them into bullets during class.

I wouldn't abide the smearing of my son.

File suit, I hate lawsuits but sometimes they are the only way lessons are learned. I wonder how many kids are runnin' around with Weed t-shirts or teh Gangsta look. Do Not show in Uniform unless you are working, they will LOVE to call your agency and say you tried to intimidate/threaten them with your position. This isn't about him being a cop's kid but a gun owner's kid. BTW Glock is/was also a big name in industry and sewing machines.

Definitely take it up with the Superintendant. Be firm, be polite, and don't let him pat you on your head and send you on your way. Even better, bring someone who looks like a lawyer, to take notes.

The more I think about it, since idiotic crap like this stays on people's records (and thanks to computers, FOREVER) you need to get a lawyer and get this reversed and taken off his record. The moron pushing the policy needs to be publicly shown for the incompetent stool sample that he is, and ideally run out of town.

He (your son) and you are not accepting the gov't programming that "Guns are bad".

I seriously hope there is some avenue you can take to force the school to give your son credit for the days they made him miss over a WORD. They effectively banned a WORD. It's not a curse or an obscenity, even. I'll bet if your kid showed up with a pen that had the word "fuck" on it, the punishment would have been less severe.

I would contact and attorney and make an appointment with them following the appointment with the super.

I am of the belief that usually people only learn their lesson when you hit them where it really hurts, their wallet.  Even if it was a bluff I'd start talking about legal recourse for them wrongfully removing your son from school and would probably pay to have a couple scary lawyer letters sent their way.  I would then be sure he had a case of block pens to use for the duration of his time at the school  Follow up with the local media for removing a good student from class because of his pen.

Spend the 3 days of suspension target shooting with your son.
