I was having dinner with my wife at a local pizza joint, and about 5 cops came in half way through our meal.
I open carry regularly, as I'm not yet 21. I got up to get a refill on my drink and I could feel ten eyes on me, staring at me like I'd just murdered some old folks and raped a goose. As we got up to leave biggins (a massive fat motherfucker who couldn't chase down a dead person) pulls me aside. Officer Biggins: C'mere son. Me: Sir? OB: You got yer concealed weapons permit for that there? Me: No, sir, and as you can see, it's not concealed... OB: (mumbles something under his breath) well, if you did, you know ya couldn't be brandishing it like that.. Me: Roger, thanks for the info. First off, in an open carry state, if you have you're concealed license, could you not carry open/concealed? Also, I don't believe carrying openly, never once having touched my weapon, quite fits the definition of "brandishing" Lastly, until I break the law, please leave me the fuck alone, officer biggins, thanks. |

Someone correct me, but I've heard/read internet opinions that "brandishing" involves more than even holding a firearm in your hand to display the fact you have it.
Does "brandishing" not require an aggressive element? ie, pointing at someone, or directing it's aim in the general direction? Not that I would ever do it, but I've contemplated exposing my concealed weapon to someone who was contemplating trouble. I don't think that would meet the definition of "brandishing". But I'm not positive. |
