Afternoon all.

I'm considering building a SBR. Can anyone point me in the direction of something that tells me the rules/steps for complying with Uncle Sam? I'd hate to wind up in the pokey for stepping out of my "thou shalt" box.

I just dropped off my Form 1's at the Sheriff's office today for him to sign and return to me. Here was my process:

http://www.atf.gov/publications/firearms/nfa-handbook/

1. Purchase lower receiver
2. Send it to Orion Arms to have it engraved with your name/city/state   http://www.orion-arms.com/gun-engraving/short-barrel-rifle-engraving-locations.html (yes, despite what you may hear, you DO have to have it engraved).
3. Get two Form 1's from the ATF. Get two ATF fingerprint cards as well   http://www.atf.gov/forms/dcof/  Alternatively you can download the fillable .pdf here http://www.atf.gov/forms/download/atf-f-5320-1.pdf and print it on your own printer. Make sure you print both pages on one sheet of paper (front/back). You can use two standard FBI Form 258 fingerprint cards supplied by your local PD. if you do this, you'll need to enter the BATF's ORI number, which is

WVATF1100
ATF-FFLC
Martinsburg, WV


4. Fill out Form 1's after engraved receiver is returned (debatable as to whether it needs to be engraved first, or get the NFA stamp first. Box 4h needs to match what is engraved on the rifle
5. Download and fill out one form 5330-20 Certificate of Compliance. Fillable .pdf is here  http://www.atf.gov/forms/download/atf-f-5330-20.pdf
5. Get your CLEO to sign the Form 1's
6. Attach a 2x2 passport photo to each Form 1
7. Mail to BATF with $200 check
8. Wait about 3-5 months

For an SBR, you are actually registering the lower receiver as the SBR. Technically you are the "maker" of the SBR even if Armalite originally made the lower receiver. Theoretically, you can't have a short-barrelled upper in the same residence as an unregistered lower as that constitutes "constructive intent" to make an SBR illegally.

Along with name, city and state do you put street address?

Also, you're supposed to put your full name on the Form 1 so therefor do you have to write out your middle name on
the reciever exactly as it's on the Form 1?

Start here

The first thing you should do is decide if you are going to submit the paper work as an individual, trust, trust or corporation.  I used a trust.  It cost a little more up front but it's a one time cost makes the process easier.

This is good gouge, thanks a ton.  I think this is gonna be my cold season project. I've got a sherrifs deputy across the street and a city detective a few houses down, so hopefully I can get an inside track on the signature piece.  The forms seem pretty straight forward, so I don't foresee any issue with that (but it is govy, so...).  And finally I have a machinist buddy who has an engraving machine.

So I guess I'll be filling out paperwork this Saturday morning over coffee.

I appreciate y'all schooling me up on this.  I have never really gotten the SBR fever much before, but I was watching a few guys work those things on CQB drills recently and it looked like a darn good rifle to have.

"Commonly accepted abbreviations" are OK, so your first initial and the two letter abbreviation for your state are fine. You specify that in box 4H of Form 1.

As to your LE buddies, note that only the chief LEO or his official designee can sign it. So Sheriffs and Chiefs of Police aren't so keen on signing off on Form 1's and Form 4's. It helps if they're aware that they don't have any liability for your actions.

Unless that "unregistered lower" is actually a pistol lower. If you buy a pistol AR lower, you can then go ahead and buy your preferred short-barreled uppers now. Rather than waiting for all the paperwork before you then get in line to get the upper you want.

Just keep the shorties right there with the pistol so there is no "misunderstanding." And keep them off your rifle lowers until and unless you get it approved as a SBR.

Two things.

This ORI is not actually the one you get on the cards that are for NFA. HOWEVER, ATF doesn't seem to care what's in that box as people are getting approved with all sorts of things.
