You are almost 100% going to be charged and convicted of somekind of intentional maiming  and unjustified deadly force if you use less-leathal on perps.

You basicly convict yourself of unjustified deadly force because if you needed it, they why did you use less lethal, answer, cause you didn't need to, and off to jail you go.  In some places, just pointing a firearm, loaded or not, is deadly force.  Might aswell get the biggest bang for your buck and put the guy down for good.
