As is with ANY new gun, some people have reported some problems.  
After a trip back to Marlin, any problems were fixed.

Marlin is in the process of being moved by the new owners, so if you have a line on one, you better buy it because there may be an gap between production while the move is made and they may be hard to get for a while.

Some people don't like the new Marlin because of the rebounding hammer and cross-bolt safety.
The rebound feature can be deactivated by following instructions you can find on rimfire central.

The rifle itself is still made the way it was in 1897:  From solid forged steel and American Walnut.  NO plastic, NO aluminum, NO zinc, NO painted-on finishes.
When you buy a Model 39, you're buying a rifle your great great grand kids will be fighting over.
