I bought a few suppressors through a local dealer back in June (maybe July.) They started the process (to my knowledge) of transferring them from the manufacturer to my dealer at that time.

It's now nearly December and my dealer just tells me "nothing yet." Not even arrived to start the form 4. I have bought nearly 20 suppressors and I've NEVER had this happen, though these are the some of the first through this dealer.

Do I have any recourse here? I know the NFA is a waiting game and you have to be patient, but I'm beginning to wonder.

I had this happen to me on a $19,000 MP-5 SD years ago. I ended up calling ATF and they said they never even received the paperwork. This was 9 months later when transfer took over a year. I had to get a lawyer involved and of course the MP-5 was sold to someone else. I ended up with a M16 HB from the dealer after the lawyer intervened. Call and see if they received any paperwork.

Your best bet is to try to convince the dealer to show you evidence that the suppressor has been ordered and/or that the Form 3 was filed.

If you had the serial number, you could (depending on your ethics) call the ATF and pretend to be the dealer or a representative of the dealer and find out the status of the Form 3.

Ethics? I have called on Form 3 before, and all they asked was who it was from, who it was going to, type of item and serial #. Is that not kosher?

I had a form 3 take over a year just recently.

Lots of fuck ups at both the manufacturer and the ATF resulting in not one but two sets of lost paperwork, then the third time being the charm had an error on it and the manufacturer failed to respond in time so the form was cancelled. The FOURTH attempt finally processed, only when my dealer got involved. It was a comedy of errors.

The form 4 on that transfer just arrived yesterday after 232 days... all said and done this transfer almost took two years to process.

My last form 4 took 411 days with no errors and no delays on the 3 side.

I think the NFA game may finally be outside my patience, by the time my stuff gets approved major industry improvements have been made

What did you buy?
Did they buy direct or use a wholesaler? If so which one?

Have you talked about cancelling the order? Could the dealer call the manufacturer and see what the hold up was?

It's not like Silencerco cans are rare or hard to find.

I did pay. And I've had a relatively smooth go of my NFA hobby until the last couple times.

And the reason I switched dealers in the first place was my old "trusted" one got a divorce and fell off the face of the earth with a lot of my stuff in ATF jail, which was a nightmare.

SilencerCo doesn't do direct. They sell through distribution only.

I see two possibilities.

Dealer is lying. He never placed the order even after taking your money.
Dealer placed the order but the distributor is stepping on their dick and never filed the F3. And the dealer never followed up.

Regardless, both of these scenarios are still on the dealer. He should fess up or give you your money back.

My best advice? Cut bait. I was given a sage piece of advice several years ago when I got into this game. If at the onset of a business relationship things are all fucked up- that is the BEST it will ever be. It will deteriorate from that point forward. Don't try to ice skate uphill.

Demand a refund/ contact credit card companies/ buy from a reputable dealer with in stock inventory. You can't swing a dead cat and not hit a dealer with a shelf full of cans. You've had some bad luck with your past couple dealers. Where are you located at? I am sure that one of us can give you a dealer that actually has their shit together.

As a customer you gotta love that attitude after having PAID for the item. Customer service at its very best. FATF and any ahole that treats customers like that. People still wonder why NFA dealers are suspect like used car salesman.

And I am NOT suggesting my dealer did anything wrong. I just fired off an email to him, and I'm sure he will make this right. I just was curious if maybe I was jumping the gun, but it sounds like I probably have a legit gripe. Unfortunately I also paid in cash

Never pay cash to a dealer for cans. too much can go wrong.

I know that you don't want to throw your dealer under the bus but I don't see how this isn't his fault. It was his responsibility to get you what you ordered. I can name off at least 6 distributors that have had all those products you "purchased" in stock since July/August. And I'm not even in the retail business.

Waiting for a F3/F4 that has been filed is one thing. Waiting to even get one started because of ineptitude is something entirely different. Demand your money back and buy from someone that has their shit together.

True on this. But worse case senario if OP has to take said dealer to small claims court then a trail of paperwork of him asking where or what's the deal with his PAID order helps in court. Otherwise dealer can always deny op ever calling.

Cuz I been there and done that. Many many small claims courts filed over the many years of a previous business venture.

An update...

It took a while to get a hold of him, and when I went there he was closed during business hours. But I finally got a hold of him and he said he would call the distributor and ask and call me the next day. I didn't receive a call back, so I called him the following day, and he said he hadn't heard back, but would try them again. This happened two more times over a week, and he finally said they were supposed to call him the next day. No call. So I called and left a message and said I'd be in the next day for a refund (they're not close, so this required a day off work.) When I got in, he said the distributor somehow never got the order, and that when his book keeper came in the following Monday he would refund my money. I called and his book keeper hadn't been in, but he said she'd be in Thursday and he'd have a check for me that afternoon. So I'm going in tomorrow, hell or high water, to get it.

We'll see. I'll update later.

Some of this was my fault because my work schedule made it extremely inconvenient to call when I would have liked, but after 5:30 it didn't seem like he'd pick up and they're open until 6. I had to leave a lot of messages. Presuming I receive my refund tomorrow I'll just consider the matter closed and hope silencers are removed from the NFA

I had a form 3 take six months this year.

ATF lost the form. I wrote a note explaining the issue and added it to my form 4. I doubt it will help, but it was cathartic to write.

I had an odd one a few years back. I paid my dealer for the can and the stamp (last time I paid someone for a stamp vice sending my own check). 6 months went by and I received stamps for cans purchased after that one. I emailed Ted with questions, and sent in supporting emails and the receipt from the dealer. After a few more emails, the NFA branch approved the can without providing proof of payment from that dealer. Very odd indeed.

Thats how I see it. I would be beyond pissed. Sadly Im sure the dealer in the end could care less. prob more upset on the $$ he is out vs the year hes dicked you around.

The guy has a store full of inventory, a good reputation, etc. He also seems like a good guy, really big into cancer charities. I'm going to give him the benefit of doubt that somehow I'm missing something here. HOWEVER I am going to post the name once I receive my refund. I can't imagine a couple of grand is a big deal to this guy, so I'm really not sure what's going on.

So I got my refund, and have now got an actual verifiable account of what happened.
. Apparently Academy said his SOT was out of date, which was untrue. He forgot to check, as did I. The run around on the refund I'm not clear about, but I've decided not to release the name BUT I will tell anyone in PM if they would like to know.

So you're telling me he forgot about the whole thing and never bothered to check where the Form 3 was for six months? Either he does so much business that he can afford to just let customers orders slip through the cracks or he's just full of poo.

That's what he said. I'm to blame to some extent because I have about 40 NFA items, and I've gotten used to the wait, so I try not to be "that guy" and call all the time. Clearly that didn't work out for me this time

In that time, though, I've had SO MANY PROBLEMS, and only 1 that I can identify as my fault (ATF losing shit, being wrong about their own policies, bad NFA dealers, theft, etc.) so at this juncture the bar is so low for what I consider to be acceptable service, my perspective is screwed up.

But I think I'm done buying NFA stuff now. Too many problems, not worth the hassle. Hopefully Trump's kid makes some NFA progress. I'd lose a lot of money, but I'd give it all up to buy shit over the counter!

I'm waiting on two form 3's from SS to my dealer from June. I don't believe the dealer in your case would initiate the form 3, the manufacturer would. As someone else said, best bet is have you're dealer show you proof that the item was paid for then asked the manufacturer what the status of the F3 is.
