Well this story sucks, so I thought I'd share. I was engaged until about two weeks ago. She just leaves after one night when we get into a fight, never talks to me, never says anything, just leaves. So of course I send flowers, appologize, get mad, get upset, normal ranges of human emotions etc.  

Anyway she kept the engagement ring so far which I am trying to get back as it is worth close to $10K but haven't heard a peep from her, but I still had the actual wedding ring so I took it back today and ordered me a giles sling with a GG&G front and rear side swivel amongst some other things.

Do I feel better? Well not really, but I do have a cool new sling system on the way and that for the moment is good.

THIS IS NOT LEGAL ADVISE!  I am not licensed to give you legal advise, we do not have an attorney/client relationship of any kind.

If I were in a situation similar to you, I might tell her you if she doesn't return the ring, I have a cause of action and tell her that I will file suit against her for the recovery of the ring, as well as all court costs associated with the action. If she hung-up on me, I would send her a letter via certified mail. If she refuses to sign for the certified, I would head down to the court house and fill out civil papers and pay the fee (prolly like $80.00 or so, depends).

Was not the engagement ring presented with the understanding that she was to marry? Was the ring a "gift" without the anticipation of marriage? California statutes (Civil Code section 1590) says that if she called off the wedding, or if it was called off by mutual consent, the ring (or its value) must be returned.

Again, this is NOT legal advise.

Your sling will still love you, no matter what the reason.  Look at the bright side of things, its much cheaper to find out what she is like now, as opposed to finding out 5 years from now.  You are getting off cheap.

Go find the right women, and it shouldn't take a large ring to make the right one happy or want to be with you.

My buddies who've had engagements go south also had the "throwing of the engagement ring" as part of the ceremony. Sounds like your ex went to a different woman's school than most.

For $10K you'd better talk to a landshark. And if all you go for the price of the other ring was a sling you might have found the reason for the unengagement.

I didn't pay $10K, I got a through a real diamond wholesaler who sells diamonds to retail outlets and jewelry stores. Normally they never sell to the public, in fact they just work out of a large warehouse with a vault and some geeks with polishers. They cut the diamonds there and then they sell to the stores that everyone else goes to which the diamond is then marked up at least double to keep the market intact.

To make a long story short- I made a mistake of getting upset about some icy road conditions because she lives nearly 50 miles from my home. We got into it a bit but also the stress of the wedding being three weeks away. The next day after church she ends things without so much as a conversation. Now I of course get upset and leave but I left without the ring. The week before she did this I gave her a bunch of money to help her with some bills.

Suffice to say I later sent some more e-mails asking her to talk, etc. I then sent flowers, a card, etc.

Never heard anything back, not anything. So I sold the actual wedding ring today but she still has the engagement ring with the rock that is worth a chunk. Now my understanding at first was perhaps she is thinking about things, but now being two weeks without a peep and after I sent her several e-mails asking her to just talk with me I am starting to wonder.

So I took the one ring back and bought some AR stuff, but the other one, I have no idea, I am hoping she is thinking about things but then again if someone just ends things three weeks before a wedding without so much as a conversation or without warning then I have to wonder if perhaps this was a good thing anyway.

Still waiting but will hire an attorney in the next couple weeks if need be since she won't even talk to me at all.

That sucks about the girl and the ring. I would try to get the ring back and count your blessings that she left three weeks before the marraige and not after with half of your stuff.

I say this not to be a dick but to everyone who cant understand why he paid that much for a ring, 10k is not that much for a nice diamond ring, especially if you love the person. 300k now that is a lot for a piece of jewelry....

Unless you are making around $200k a year, $10k is wayyyyy too much to spend.  The traditional rule of thumb is a man should spend around 1 months salary after taxes on an engagement ring.

Maybe I am a cheap bastard, but $10k is an awful lot of money to spend on something with no practical use like a diamond ring.  Love and material things don't really have that much to do with each other in my opinion.  I spent less than $1k on my wife's engagement ring, and that was a lot of money to me 10 years ago.

She walked 3 weeks before the wedding??? I'm guessing that, unless you have some money-back guarantees, the caterers, room/hall rentals invitations, etc. could end up costing a little more than the $10k-something ring. Ouch. If her parents were picking any of that stuff up, expect to hear from her soon (after her father gets involved). THEN get the ring back and ditch the lady (or whatever you refer to her as these days). SAVE YOURSELF FROM IMMINENT DOOM. YOU'RE TOO YOUNG (whatever your age).

If she left with out a word sounds like she had somewhere  else to go.Involve her parents and by law she has to give the ring back although if you can afford a rock like that she would have been smarter to marry you then divorce you at some point and make even more than 10 grand...no offense but the story sounds a little suspicious unless you spent your life savings on the ring in wich case if thats all she was after you should have seen some signs but that depends on how long youve known her.Too many unknowns to realy make an opinion on this story.With the extra ring to sell and buy your sling sounds like this isnt the first time youve had this happen.

I never spent $10K on the ring, I spent less than half that but I bought it from a wholesaler who cuts diamonds. Honestly she had e-mailed my mom not even two days before, we went to dinner, then the next day we go to church and bam she hits me with not wanting to go through with it anymore. No conversation, nothing at all, just over. Then I of course send e-mails, flowers, and two phone calls in the last two weeks. Hear back nothing at all except don't ever contact me again, hell two weeks earlier we're on track to get married. I will get a lawyer if I don't get the ring back before long.

How the hell did you find a way around the DeBeers diamond cartel?  They control all the diamonds that are brought (legally) into this country and keep the prices pretty consistent.  You can't really get a great deal on a diamond.

I'd like more info on this discount diamond cutter.

+1000 on taking her to small claims court and getting your money back.

I know it's gotta hurt and you're still hoping for the best, but anyone that would pull a stunt like that is a bagful of other problems in the future, so count your blessings.

Make sure you have your receipts lined up for court.  That is the MOST important thing you'll need.  If there were witnesses to the breakup, take them to ensure it's clearly understood she broke it off, not you.  Take your receipts and emails for flowers and such to prove you did what you could to reconcile and any evidence you have (certified mail receipt) demanding the ring back.

The only problem I see here is what the cap is on small claims in your area.  Most of the time it's $5,000, but some places are less than that.  The bad news is that even though you bought it through a wholeseller at a reduced price, it's highly unlikely that you'll get anything close to what you paid for it.  I'd expect maybe $2,000 if your lucky.  Pricing on gems works that way.  Still, $2,000 is better than nothing.  The good news is, if she decided to ditch or lose the ring you can have the court place a judgement against her for the full value you paid for it.

Good luck brother.  Time to move on.  The best message you can send her at this point is you don't care and you're going on with your life without her in it.  You're just taking care of the small pieces of business between you two that need to be finished.

Without any knowledge of your state's laws, this is grossly incorrect.  Generally, promises to marry fall under the Statute of Frauds, which requires that such promises be written down in order to be enforceable.

Maybe you could bring a suit under a detrimental reliance theory, but I don't think a court would entertain it.  Would we really want angry engaged couples bringing their suits to court?  

You can always bluff at her to get the ring back...but as far as hiring a lawyer, I think it would be a waste of time, money, and more importantly, it would be even more emotionally draining.  If she won't give it back (and you're not willing to hire someone to steal it from her house), then just walk away and move on.  Easier said than done, I know.  Good luck.

Well..there's some right and some wrong in both of these statements.

What is right is that the handling of engagements sometimes varies state to state, so yes, you do need to check what it is in your state.

The MOST prevalent handling of engagements throughout the US is what was stated earlier in that it is viewed as a "gift in anticipation of a future event."  Therefore, if the future event does not happen it is no longer a gift and ownership reverts back to the original buyer.  Circumstances on this vary from state to state as far as what may have caused the future event not to happen.  It's not a contract either, but it's typically handled much the same as a contract so pain and suffering is not considered a compensible element.

I have NEVER heard of any state that deals with this under Fraud laws, unless it was a case of someone accepting an engagement ring and at the time of accepting it knowingly had no intention of marrying the person.  BTW, fraud is simply a special case of a contract in which there was never an intention by one of the parties to deliver, and contracts can either be oral or written.

There is only one consistent theme among all of the advice I have ever received from various mentors, teachers, NCO's, officers, etc. -- all of them married.       "Listen, man, don't ever get married"

I'd like to take that advice but one day some woman might crack me over the head with something, and then I'll wake up married.
