A good friend of mine is in big trouble with the ATF over one he got off of a walker at a local fun show.

You would have thought that CIA would be smart enough to know what a FA receiver looked like. I remember seeing these a gunshows a few years ago along with the MAK-90s' that were made with underfolding receivers.
Link Posted: 8/22/2005 11:42:30 AM EDT
I remember two different times that happen. One was a Chinese sporter with Chinese characters for the selector marks and yes, there was a full-auto position and mark. These receivers were set-up for an underfold, but had a fixed stock installed. These had a auto-sear pin hole, filled in with a rivet.

The second gun that I remembered was the Egyptian Maadi, imported by Intrac. These These guns had the auto selector mark removed and a rivet install where the auto sear pin would normally go.

If you're buddy bought it with legit intentions, everything should be OK, (I hope!)

Were they (the FEDS) watching from the next table down? How did your bud get caught and if it was at the show where he bought it did the asshole selling it get arrested too? Were the FEDs the ones selling it in the first place? This is a good post cause I didn't know such AKs existed. If your bud bought it from a walker like you said with no info exchanged, I don't see how he was caught if he made it out of the show without being tagged by the ATF. If he got tagged at the show, then this sure seems like entrapment to me. Not enough details. BTW, I'm only a lawyer in my spare time.

A similar thing happened years ago with imported G3s. There was litigation and ATF either decided, or was ordered, to recognize the rifles as being lawful semi-auto guns, with letters going to the owners. I don't remember all the details on this one. You need to talk to Bardwell. He's the expert on NFA law.

A number of these rifles came in. I remember seeing them at gun shows in 1993 and 1994. I am interested in hearing what else they charged him with. There's probably more to the story. . . .

I don't know all the story my self. What i've posted is all i know.

I do know that possession of an unregestered mg is all that he was charged with.

I do not see how this charge could ever hold up. I would like to see documented video evidence of this gun shooting in full auto. Fact is it never will without the extra parts, and the rivet removed.

Either this is total BS or there is more to this story. Law enforcement can't sell a FA receiver to someone and charge them with possession of an unregistered machine gun UNLESS the guy buying it THOUGHT he was buying a machine gun. If he thought he was buying a semi MAK then he committed no crime.

P.S. I distinctly remember a strikingly similar story in a post last year sometime. Maybe a team member can do a search.
Link Posted: 8/22/2005 8:09:54 PM EDT
I don't know much about the law but I know they have to prove "intent", that the perpetrator intended to commit a crime. Years ago my ex-wife used a suitcase of mine and got busted at the airport because the Makarov I carried on road trips was still in the suitcase(I had already told her never to use my suitcase!). She got off with a little community service and Deferred Adjudication, it was still a nightmare though ...

If you can find any thing at all please do so.
Thanks.

is this a friend or your brother? in any case, he better hire a very good attorney, and I mean a very good one. not to win the case, because frankly I don't think he has a snowball chance in hell, but to get the lightest felony sentence as possible.

Ive seen a few of the post ban MAK90 with the third hole with a rivet in them on gunshow table.......one was at colorado springs, when I was stationed at Ft. Carson,by a dealer that went by the name DRAGONMAN, which kinda surpised me as he also is class 3 dealer as well......... and a couple here in NE ohio.........I didn't stick around too long at those tables

yeah he is quite a character, transplanted new yorker, visted his shop, before I saw that MAK90 on his table........out in the middle of nowhere, down a bumpy tank trail lined with cars, the name of the road was something like dragonman way. that's why it really surprised me to see that MAK90 on his table..........I figured if anybody would know that would be consider a illegal MG, it be him.

Don't know the point you're trying to make but the page states that

"1) convicted felon in possession of a firearm in violation of 18 U.S.C. § 922(g); 2) possession of an unregistered chrome silencer in violation of 26 U.S.C. § 5845(a); 3) possession of an unregistered firearm in violation of 26 U.S.C. § 5861(d); and 4) possession of a machine gun in violation of 18 U.S.C. § 922(o)."

Reading the document sounds like a justified bust

I had 1 until this July. when I found out what it was I gas axed into into 3 pieces. Took lots of pics before and after. If I could figure how to post them on this board I would. Told the story with pics over on Gunco. Look in the build it yourself forum, thread is titled "Dip by trigger hole". Was also stamped for underfolder. Was a nice rifle, shot well.

Those are the ones. I bought it legal, at a pawn shop, filled in all the paperwork. Came brand new in the box. Like I said, when I found out it MIGHT be questionable, I destoyed it.

Sure painful to cut it up, but much less painful than your cell buddy with his fist up your rectum.

The Chi Com AKs in question, all came over in the last shipment of MAK 90s allowed in.The Chinese used any recievers they had avaliable to fill the shipping containers, the guns were processed and distributed before anyone noticed that some of the MAK 90s were built on made for export select fire recievers. On the ones I've examined, the bolt carrier had been neutered, the fire control parts were all semi auto and the "third hole"had an overlength rivet through it,also doubling as a selector stop. For more info, you can do a search on the "China/Clinton Connection",pay attention to the Cosco shipment.

Waiting on a Global Trabes 1.6mm 100%. The chinese used the thick metal, same as the RPKs and Yugos. I now have to build it to comply just like any other kit, I'll post when it is completed. I have been following some other MACs for sale that have the stamped area for the underfolder, have not seen any others with the sear hole.
