Hi,

selling an upper that is a p&W 13.9 to make it legal to 16 Overal length barrel. However it has the surefire flash hider on it. person says they have the mag lock on the lower which allows flash hiders.

Any uppers are legal. How the owner uses it may or may not be.

Constructive possession of short barreled rifles is still a thing here, but that's on the buyer unless he tells you his intent to build an SBR. Your post wasn't very clear, but if the flash suppressor is permanently installed, then it's just parts to ship here. If the buyer is lying and doesn't have the appropriate lower to put it on, it's still on him.

You should be in the clear.
