Yeah, it's really hard to get excited over this. The laws aren't going anywhere and I highly doubt the SCOTUS is going to do anything for us regardless of who's sitting in Kennedy's seat. We've had like 52 years of getting ass raped by the politicians in this state so why should any of us believe anything will change? It's been over a half fucking century and we've been given nothing.

Court to Hear Argument on Injunction Request Tomorrow
July 11, 2018. ANJRPC’s federal lawsuit to overturn Governor Murphy’s firearms magazine ban is starting to pick up speed. There has been a flurry of activity since the court scheduled an expedited hearing on ANJRPC’s request for an injunction (to halt enforcement of the ban until the case is decided).

The State of New Jersey was first to oppose the injunction motion, arguing among other things that the newly banned magazines are “dangerous and unusual weapons” not protected by the Second Amendment, which pose a danger to the public even in the hands of law-abiding citizens. The State also argues that the banned magazines are not needed for self-defense, but are “perfectly suited for illicit use.”  

“Claiming that banned magazines are not needed for self-defense while simultaneously exempting their use for the protection of lawmakers is outrageous and the height of hypocrisy,” said ANJRPC Executive Director Scott Bach. “This elitist double standard is irrational, indefensible, and shows the utter contempt New Jersey has for its ‘subjects,’” said Bach.

Piling onto the State’s papers, the Giffords Law Center and Everytown For Gun Safety filed their own opposition to the injunction motion, arguing among other things that standard capacity magazines are best suited for military use, that NJ’s prior regulation of magazine capacity for several decades makes the new ban presumptively valid, and that the ban will make mass shooting incidents “less lethal.”

On July 9, ANJRPC ripped all of these arguments to shreds in a reply brief filed in the case.

Tomorrow (July 12), The U.S. District Court is scheduled to hear argument on ANJRPC’s request for an injunction halting enforcement of the ban. A decision on the motion could come later this month. 

This case was filed in cooperation with the National Rifle Association. “We thank the NRA for its incredible support and guidance, which made this aggressive lawsuit challenging the magazine ban possible,” said Bach.

Today is 7-12, our day in court?

Fingers crossed.
People said Donald winning would have been a miracle, preventing another Kagan from getting into Scalia's seat would have been a miracle - we were supposed to be down to a blue wave starting now with no hope of keeping ANYTHING in the midterms... Depending on who you believe we've had a lot of miracles.

Upon further reflection (and reading the update), they scheduled another hearing for a month from now, and won't expect a decision on the injunction until at least middle of September.

God, I could never be a lawyer.  The way they can just drag this shit out endlessly would have me throwing things in the court room.

Court Schedules Factual Hearings In Mid-August

No Decision On Injunction Before End Of Summer

 

July 12, 2018. This afternoon, a U.S. District Court Judge in Trenton heard oral argument on ANJRPC's motion for an injunction halting enforcement of the new magazine ban law until the case is decided. 

 

U.S. District Judge Peter Sheridan called a pre-hearing conference in chambers where he told counsel that he is scheduling a full-blown hearing on certain factual aspects of the case by mid-August. Specifically, experts who provided declarations for both sides will be brought into court to provide further detailed testimony under oath.

 

Following the conference in chambers, Judge Sheridan heard brief oral arguments from both sides. 

ANJRPC's legal team included attorneys from the law firm of Cooper & Kirk in addition to attorney Dan Schmutter. Counsel made a forceful case for why the injunction should be granted and the case resolved in favor of gun owners. They argued that New Jersey's gun owners would suffer irreparable harm if they are forced to sell, surrender, destroy or modify their property during the short compliance window, before the case is decided. They also argued that the magazine ban is unconstitutional and should be overturned because it violates the Second Amendment, violates equal protection, and is an unlawful "taking" of property.

A large group of attorneys represented the State and other governmental defendants. They argued (among other things) that magazines over 10 rounds are dangerous and unusual weapons not protected under the Second Amendment, are not needed for self-defense, and are a danger to the public, even in the hands of law-abiding citizens.

CA mag confiscation upheld

A Ninth Circuit panel on Tuesday affirmed a federal judge's order preliminarily barring California from enforcing a voter-approved ban on high-capacity gun magazines.

In Duncan v. Becerra, U.S. District Judge Roger Benitez temporarily blocked a portion of Proposition 63 that prohibits possession of magazines holding more than 10 rounds of ammunition. The issue is set to go to trial this fall.

California Attorney General Xavier Becerra appealed to the Ninth Circuit, arguing Benitez abused his discretion in granting the injunction in favor of Virginia Duncan and the California Rifle & Pistol Association.

But in an 8-page unpublished memorandum issued Tuesday, U.S. Circuit Judge Norman Smith and U.S. District Judge Deborah Batts of the Southern District of New York ruled Benitez used the correct level of scrutiny to decide the preliminary injunction.

"The district court did not abuse its discretion by concluding that magazines for a weapon likely fall within the scope of the Second Amendment," the judges said, adding that Becerra hadn't pointed to any errors made by Benitez.

"[Becerra's argument] is insufficient to establish that the district court's findings of fact and its application of the legal standard to those facts were "illogical, implausible, or without support in inferences that may be drawn from facts in the record," the majority held.

In his June 2017 order, Benitez said gun owners' "entitlement to enjoy Second Amendment rights and just compensation is not eliminated simply because they possess 'unpopular' magazines holding more than 10 rounds."

In his dissent, U.S. Circuit Judge John Wallace said a "reasonable fit" between gun owners' rights and Proposition 63 can be accommodated if the state can show it does not challenge or burden core elements of the Second Amendment.

I know it is hard to be patient.  We soon will have Kavanaugh in SCOTUS, for sure President Trump (yes!) will have at least one other nomination, possibly two.  That is when the time is right to accept and rule on the issue of the Second Amendment.

Things are a changing!
