The Texas Criminal Court of Appeals has struck down the ability of the Texas Attorney General from prosecuting any voter fraud in Texas. Instead in the ruling all voter fraud must be must be prosecuted by the county DA’s.

Now, the 9 judges on the Texas Criminal Court of Appeals are ALL REPUBLICANS! The decision was a 8-1 decision.

IMO the AG prosecuting voter fraud would bring continuity in protecting the vote through out Texas. The heart of voter fraud in Texas are Harris and Travis counties, do you want Kim Ogg and Jose Garza being responsible for prosecuting voter fraud in their counties???

By the county DA they say?  Well, a quick look across the landscape of this nation at the moment appears that's where the problem lies as it pertains to DA's being political thugs instead of serving the will of the people.

Exactly, the 5 big blue county DA’s not prosecuting voter fraud could throw all statewide elections in Texas.

Yes.  Legally correct, but in application, could be problematic.  

Its a Constitutional issue, not CCP.   Separations of powers.

Maybe the Texas Legislature ought to look at fixing that.

Yes.  Legally correct, but in application, could be problematic.  

Its a Constitutional issue, not CCP.   Separations of powers.


It is a separation of powers since the AG is considered part of the executive branch.
