Tonight the City Council of Lebanon Junction voted to completely rescind their City Ordinance prohibiting concealed weapons in their City Hall. That ordinance and sign that goes with it have been in place since 2007. This is the result of a KC3 member sending pictures of the sign on the building to KC3 board members.  Many signs like this are illegal but it is impossible to know without more information. We sent an Open Records Request to the City Clerk and the response was that there was no Lebanon Junction ordinance concerning firearms. State law requires that any city wanting to ban concealed weapons must first pass an ordinance. KC3 sent an email to the Mayor complaining about this. We immediately got a copy of their ordinance from the city attorney. After inspecting that ordinance we decided that it was improperly drafted and unenforceable. Of course, the current Mayor and City Attorney were not around in 2007 and are not responsible for passing this illegal ordinance but it needs to be changed.
We got back in touch with the city attorney and explained our objections to the ordinance and asked that it be changed to comply with the law. There were never any objections or complaints from the Mayor or the City Attorney. Both were very cooperative and pleasant. Since they were going to have to amend their ordinance anyway, I suggested that they might just as well get rid of it entirely. Those ordinances accomplish very little. Since state law only authorizes a city to prohibit concealed weapons and they can not prohibit openly carried weapons, there is little reason to do it. The Mayor and City Attorney agreed but had to put that to a vote of the entire council. You can see pictures of the signs here:

A new ordinance will have to be written to repeal the old ordinance. That will be done and presented for a first reading at next month's meeting. Then at the following meeting, a second reading and final vote will end this thing. Lebanon Junction is a tiny city and many people will say that this is unimportant but it is not unimportant to the people that live in Lebanon Junction and it is not unimportant to KC3. It could just as easily be your hometown. These signs spread like Corona Virus. They have to be stamped out at every opportunity. What about your home town? Your home county? Are there signs posted there? Are those signs legal? If you want to get rid of some signs, send pictures to KC3 and we'll look into it? What about your local parks, libraries, water companies, Fire Depts. and Health Depts. Many of those signs are illegal and can be removed. Both HB 529 and HB 610 from last year would have solved this problem. Savannah Maddox has already agreed to resubmit HB 529 and we are still working on getting HB 610 back for reconsideration. Let's put an end to this.

Someone needs to jerk a similar knot in the Hardin County Judge Executive's rear end over similar restrictions in the county court house and other county offices in Elizabethtown.

If "someone" would furnish KC3 with some pictures of any signs those things might get some attention. Even an explanation of the exact problem instead of a vague reference to "similar restrictions in the county court house and other county offices in Elizabethtown" might get that ball rolling. We normally will have 5 or 6 of these things in the works at any one time. A lot of them will not ever turn into anything because, after some investigating, we find out that the local government is, in fact, complying with the law. We would like to be reasonably certain that there is actually a violation before anybody does any serious traveling. The law allows cities and counties to prohibit concealed weapons in their buildings. If that is done in accordance with the state law there is nothing anybody can do about that but often they have been sloppy or negligent about how they did it and we can cause them enough problems that they get tired of making the effort required to do it right. Other times they are just so arrogant that they refuse to obey the law and in those cases, we end up suing them. Most of the time, it is just ignorance of the law, like with Lebanon Junction. Their ordinance was never correct and it stood for 13 years before anybody brought it to their attention because nobody bothered to look at their ordinance. Either that or nobody cared enough to look. Once they were forced to look at it and compare what they had with what the state law requires, they were glad to be rid of the whole idea.
